Lindsay, in which the Commission proposed to 13 suspend or revoke your right to apply for an Oregon teaching license or impose other 14 discipline under ORS 342.177. The notice was sent via U.S. First Class Mail and U.S. 15 Certified Mail Receipt #7000 0600 0023 8496 9693 to the address Mr. Lindsay provided to 16 the Commission. The certified mail receipt was returned to the Commission on March 27, 17 2002, signed by Richard W. Bogart (signature illegible). Thomas C. Lindsay did not request 18 a hearing. 19 20 The Notice of Opportunity for Hearing, signed by David V. Myton, Executive _ 21 Director, stated: 22 If a request for hearing is not received within this 21-day period, your right to 23 hearing shall be considered waived unless your failure to request a hearing was 24 ‘ beyond your reasonable control. If you do no request a hearing or if you fail to . 25 appear at a hearing, the Commission will adopt an Order of Default which may 26 include the revocation or suspension of your license or other discipline. 27 28 Based on the foregoing, the Commission finds Thomas C. Lindsay in default and 29 such default is hereby entered. Based on the records and files of the Commission, the 30 Commission enters the following findings of fact and order. 31 i 32 FINDINGS OF FACT 33 1. Thomas Lindsay was employed as a Chemistry Teacher at Southridge High 2 School in the Beaverton School District. He resigned October l7, 2001. 3 3. During the 2001-2002 academic year, Thomas Lindsay engaged in verbal 4 communication of a sexual nature with a 16-year old female student while driving her 5 around Washington County in his personal vehicle. His discussions with the student were 6 overly personal and sexually suggestive, including his prowess as a lover, his propensity to 7 engage in extra-marital affairs, and his desire and ability to give his sexual partners 8 prolonged and multiple orgasms. 9 10 CONCLUSIONS 0F LAW 11 Thomas Lindsay violated OAR 584-020-0040(4)(t) by engaging in sexual conduct 12 with a student. This misconduct constitutes Gross Neglect of Duty.
