1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2’ ' OF THE sTATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF REPRIMAND 5 SCOTT DAVID JACKSON ) AND PROBATION g ) 8 On or about May 15, 2002, the Teacher Standards and Practices Commission 9 (Commission) received a report from James A. Thomas, Superintendent, Scio School 10 District, alleging that Scott David Jackson (Jackson) used his school computer to 11 access a personal website during school time. 12 Mr. Jackson fuIIy cooperated with the Commission‘s investigation. After review 13 Of the matters alleged, Mr. Jackson and the Commission agree that their respective 14 interests, together with the public interest, are best served by a stipulation to certain l .5 facts and a Public Reprimand, followed by a one (1) year probation. 16 This Order sets forth the facts upon which the parties have agreed and the 17 sanction to be imposed. Mr. Jackson stipulates that there are sufficient facts contained 18 in the Commission's files and records to support the findings Of fact and conclusions of 19 law set forth below. In entering into this stipulation, Mr. Jackson waives the right to a 20 hearing to contest the finding of fact, conclusion of law and order set forth below. 21 This stipulation is contingent upon approval and adoption of the Order by the 22 Commission. If the Commission does not adopt this Order, neither Mr. Jackson nor the 23 Commission are bound by these Stipulations and Mr. Jackson retains aII rights to a 24 hearing on the allegations. 25 /// Page 1 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - JACKSON 1 STIPULATION OF FACTS '2 1. Mr. Jackson holds a Basic Teaching License with a Basic Advanced 3 Mathematics Endorsement valid May 11, 2001, through September 8, 2004. 4 2. Mr. Jackson was employed by Scio School District on a temporary contract as 5 a math teacher at the high school from November 26, 2001 to June 12, 2002. On May 6 15, 2002, Mr. Jackson was reprimanded for personal use of district equipment. 7 3. A District-owned computer with Internet access was present in Mr. Jackson's 8 classroom for his use in connection with his assigned responsibilities. The District has a 9 clearly defined, acceptable use policy. The District's policy prohibits the use of 10 equipment for personal purposes. 11 4. Mr. Jackson used his classroom computer to access a personal website on a daily basis. i1 5. Mr. Jackson 24 was fully aware that accessing this website at the workplace with a District owned ‘ computer was inappropriate and in violation of District policy. Mime/Cl“ Page 2 STIPULATION OF FACTS, ORDER OF SHSPENSiONAND PROBATION - JACKSON 1 CONCLUSION OF LAW '2 Scott David Jackson's behavior constitutes gross neglect of duty in violation of 3 OAR 584-020-0040(4)(b). The Commission's authority to impose discipline in this 4 matter is based upon ORS 342.175. 5 ORDER 6 The Commission imposes a Public Reprimand on Mr. Jackson. This Stipulation 7 of Facts, Order of Reprimand and Probation constitutes the reprimand.
