CONKLIN ) 7 On January 25, 2007, the Teacher Standards and Practices Commission (Commission) 8 issued a Notice of Opportunity for Hearing to Jennifer R. Conklin (Conklin) in which the 9 Commission denied Iicensure based on ORS 342.143(2). The Notice was sent via U.S. First 10 Class Mail and U.S. Certified Mail Receipt 7005 1160 0001 0494 2796 to the address Ms. 11 Conklin provided to the Commission. The certified mail receipt was signed by the educator and 12 returned to the Commission on January 29, 2007. The Notice of Opportunity of Hearing, dated 13 January 25, 2007, and signed by Victoria Chamberlain, Executive Director, stated: 14 "You, Jennifer R. Conklin, are entitled to a hearing on the proposed action of the 15 Commission. If you want a hearing, you must file a written request for a hearing 1 6 with the Commission within 21 days of the date of this notice. Attached to this I Q notice is a copy of the procedures, right of representation and other rights of parties relating to the conduct of a hearing as required under ORS 183.413(2)." 23 Ms. Conklin did not request a hearing. The Commission, therefore, finds Ms. Conklin to 21 be in default and enters the following findings of fact, conclusions of law and order, based on 22 the files and records of the Commission concerning this matter. 23 FINDINGS 0F FACT 24 1. On August 6, 2005, Ms. Conklin signed and submitted an Application for Educator 25 License Form C-1 for renewal of her Initial Teaching License. On September 28, 2005, Ms. 26 Conklin received a letter from TSPC indicating that your application was incomplete. Ms. 27 Conklin failed to respond to the letter of September 28, 2005, and her grace period expired 28 December 11, 2005. Ms. Conklin served in a licensed position with the Eugene School District 29 from December 12, 2005, to June 16, 2006, without proper Iicensure. . Ms. Conklin did not respond to requests tor information and to participate in Q interviews with a Commission representative relating to a Commission investigation. , 3 CONCLUSIONS OF LAW 4 Serving without proper Iicensure constitutes Gross Neglect of Duty in violation of OAR 5 584-050-0030(2). Failure to respond to requests for information and to participate in interviews 6 with a Commission representative relating to a Commission investigation constitutes Gross 7 Neglect of Duty in violation of OAR 584-020-0040(4)(p). Pursuant to OAR 584-050-0006(5) and 8 ORS 342.143(2) the Executive Director may deny issuance of a license based upon evidence 9 that the applicant may lack fitness to serve as an educator. The Commission’s authority to 10 impose discipline in this matter is based upon ORS 342.175. 11 ORDER 12 The Commission hereby denies the application of Jennifer R.
