‘ BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND g PATRICK FRANCIS BLUHM ) ORDER OF SUSPENSION 7 On or about April 14, 2002, the Teacher Standards and Practices Commission 8 (Commission) received a complete application for a Transitional License from Patrick Francis 9 Bluhm (Bluhm). Mr. Bluhm responded "no" to all character questions. On June 12, 2002, the 1O Commission received information based upon fingerprints from the FBI indicating that Mr. 11 Bluhm had been arrested in Minnesota on June 21, 1998. On August 8, 2002, in response to a 12 form letter Mr. Bluhm admitted that he failed to respond correctly regarding his conviction in 13 Minnesota because he believed that an affirmative response on a character question would 14 have, “...automatically ruled me out for the teaching license l was seeking." . Mr. Bluhm fully cooperated with the Commission's investigation. After review of the 16 matters alleged, Mr. Bluhm and the Commission agree that their respective interests, together 17 with the public interest, are best served by a stipulation to certain facts, a ninety (90) day 18 suspension of his teaching license. 19 This Order sets forth the facts upon which the parties have agreed and the sanction to 2O be imposed. Mr. Bluhm stipulates that there are sufficient facts contained in the Commission's 21 files and records to support the findings of fact and conclusions of law set forth below. In 22 entering into this stipulation, Mr. Bluhm waives the right to a hearing to contest the finding of 23 fact, conclusion of law and order set forth below. 24 This stipulation is contingent upon approval and adoption of the Order by the , 25 Commission. lf the Commission does not adopt this Order, neither Mr. Bluhm nor the 26 Commission are bound by these stipulations, and Mr. Bluhm retains all rights to a hearing on ' the allegations. 28 // / Page 1 STIPULATION OF FACTS AND ORDER OF SUSPENSION - BLUHM STIPULATION 0F FACTS Q 1. On April 18, 2002, the Commission received a complete application from Patrick 3 Bluhm requesting a Transitional Teaching License. Mr. Bluhm responded “no” to all character 4 questions. On April 26. 2002, the Commission issued a Transitional Teaching License to 5 Mr. Bluhm valid until April 26, 2005. 6 2. Mr. Bluhm is employed by the Bend-La Pine School District. 7 3. On June 21, 1998, Mr. Bluhm was arrested and charged in connection with following 8 an other driver, on a public highway, whom he believed had cut him off. The charges resulted 9 from a report by the other driver. 1O 4. This behavior constitutes Gross Neglect of Duty. The 23 Commission's authority to impose discipline in this matter is based upon ORS 342.175. 24 ORDER 25 The Commission adopts the above findings of fact and suspends the Transitional 26 Teaching license of Patrick Bluhm for a period of ninety (90) days effective March 7, 2003.
