s On September 24, 2007, the Teacher Standards and Practices Commission

8 (Commission) received a report indicating possible inappropriate conduct under OAR 581020-

9 0040(4)(q) by Todd Nord Wallenberg (Wallenberg), a teacher in the Medford School District
10 After review of the matters alleged, Mr. Wallenberg and the Commission agree that their
11 respective interests, together with the public interest, are best served by a stipulation to certain
12 facts and the imposition of a thirty (30) day suspension.
13 By signing below, Mr. Wallenberg acknowledges, understands, stipulates, and agrees to
14 the following: (i) he has been fully advised of his rights to notice and a hearing to contest the
15 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all
16 such rights and any rights to appeal or othen/vise challenge this Stipulation of Facts and Final
17 Order of Suspension (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public
18 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and
19 Final Order is contingent upon and subject to approval and adoption by the Commission. If the
2O Commission does not approve and adopt this Stipulation and Final Order, then neither Mr.
21 Wallenberg nor the Commission are bound by the terms herein; (iv) he has fully read this
22 Stipulation and Final Order, and understands it completely; (v) he voluntarily, without any force
23 or duress, enters into this Stipulation and Final Order and consents to issuance and entry of the
24 Stipulated Final Order below; (vi) he states that no promises or representation has been made
25 to induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an attorney
26 regarding this Stipulation and Final Order and has been fully advised with regard to his rights
27 thereto, or waives any and all rights to consult with an attorney prior to entering into this
28 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below.

1 STIPULATION OF FACTS
2 1. The Commission has licensed Mr. Wallenberg since September 4, 2004. Mr.
3 Wallenberg currently holds an Initial I Teaching License, with endorsements in Basic
4 Mathematics (HS, ML), General Business (HS) and Multiple Subjects (ML), issued
5 November 10, 2006 and valid through November 9, 2009.
6 2. ln August and September of 2007, while employed by the Medford School District, Mr.
7 Wallenberg accessed sexually explicit materials through school district computers.
8 3. As requested by the Commission, Mr. Wallenberg undenlvent a psychiatric evaluation.
9 As recommended by Dr. Craig Reed, the psychiatrist who performed this evaluation, Mr.
1O Wallenberg also submitted to a separate standardized psychological evaluation by Dr.
11 James Harper.
12 4. As Dr. Reed stated in an addendum to his original psychiatric evaluation, these separate
13 evaluations “revealed a noteworthy inconsistency between the narrative offered to Dr.
14 Harper and that offered to me" concerning how Mr. Wallenberg initially accessed the
15 pornographic sites and his reasons for accessing those sites.

1 CONCLUSION OF LAW
2 Mr. Todd Nord Wallenberg used school district computers to access sexually explicit
3 materials. This conduct constitutes Gross Neglect of Duty in violation of OAR 584-020-
4 0040(4)(q). The Commission's authority to impose discipline in this matter is based upon ORS
5 342.175.
6 ORDER
7 The Standard Teaching License of Todd Nord Wallenberg is suspended for a period of
8 thirty (30) days from the date of this order.
