JOBE ) DENIAL OF LICENSURE 6 ) 7 8 On May 30, 2003, the Teacher Standards and Practices Commission issued a Notioe 9 of Opportunity for Hearing to Yong Jobe, in which the Commission proposed to deny issuance 10 of a license under ORS 342.143 and its administrative rules implementing that legal authority 11 OAR 584-050-0006. The Notice was sent via U.S. First Class Mail and U.S. Certified Mail 12 Receipt #7002 3150 0004 3439 2346 to the address Yong Jobe provided to the Commission. 13 The certified mail receipt was signed and returned to the Commission on June 12, 2003. 14 Yong Jobe did not request a hearing. 15 The Notice of Opportunity for Hearing, signed by Victoria Chamberlain, Executive " Director, stated: 17 If a request for hearing is not received within this 21-day period, your right to 18 hearing shall be considered waived unless your failure to request a hearing was 19 beyond your reasonable control. If you do not request a hearing or if you fail to 20 appear at a hearing, the Commission will uphold the denial of your application for 21 an Oregon teaching license. 22 23 Based on the foregoing, the Commission finds Yong Jobe in default and such default is 24 hereby entered. Based on the records and files of the Commission, the Commission enters the 25 following findings of fact, conclusions of law and order. 26 FINDINGS OF FACT 27 1. On or about November 19, 2002, Yong Jobe submitted an Application for Educator 28 License Form C-1 to apply for a Transitional Teaching License at the Middle and High School 29 Level. Pursuant to OAR 584-060-0161, part of the necessary education requirements is Q documented completion in Oregon or another U.S. jurisdiction of an initial teacher education 3 program approved by the Commission, or completion of a U.S. or foreign program evaluated as 4 satisfactory by an Oregon Institution approved to offer the corresponding program. 5 3. On December 12, 2002 and February 18, 2003, TSPC notified Yong Jobe of the 6 above requirement and indicated that he would be eligible for a Restricted Transitional Teaching 7 License if he applied with an employing Oregon school district. Completion of a teacher 8 education program is not necessary to obtain the Restricted Transitional Teaching License. 9 CONCLUSIONS OF LAW 10 Part of the necessary education requirements for a Transitional Teaching License is a 11 documented completion in Oregon or another U.S. jurisdiction of an initial teacher education 12 program approved by the Commission, or completion of a U.S. or foreign program evaluated as 13 satisfactory by an Oregon Institution approved to offer the corresponding program. Jobe has not . satisfied this requirement established by OAR 584-060-0161 for a Transitional Teaching License. 15 ORDER 16 The Commission denies issuance of a teaching license to Yong I.
