1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) AND DENIAL OF 5 JAMILAH AMEERAH RAHIM ) RIGHT TO APPLY V 6 On or about August 26, 2009, JamiIah Ameerah Rahim (Rahim) signed and submitted a 7 PA-1 Application for Student Teaching or Practicum to the Teacher Standards and Practices 8 Commission (Commission). Following a routing background check the Commission found that 9 Rahim failed to disclose past criminal convictions. 1O After review of the matters alleged, Rahim and the Commission agree that their 1 1 respective interests, together with the public interest, are best served by a stipulation to certain 12 facts and a revocation of her right to apply for one year. This stipulation is contingent upon 13 approval and adoption of the Order by the Commission. It the Commission does not adopt this 14 Order, neither Rahim nor the Commission are bound by these stipulations and Rahim retains all ‘ 15 rights to a hearing on the allegations. 16 By signing below, Rahim acknowledges, understands, stipulates, and agrees to the 17 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 18 findings of tact, conclusions of law, and order set forth below, and fully and finally waives all 19 such rights and any rights to appeal or othenivise challenge this Stipulation of Facts, and 20 Revocation of Right to Apply (Stipulation and Final Order); (ii) this Stipulation and Final Order is 21 a public document and disclosed to the public upon request by the Commission; (iii) this 22 Stipulationand Final Order is contingent upon and subject to approval and adoption by the 23 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, 24 then neither Rahim nor the Commission are bound by the terms herein; (iv) she has fully read 25 this Stipulation and Final Order, and understands it completely; (v) she voluntarily, without any 26 force or duress, enters into this Stipulation and Final Order and consents to issuance and entry 27 of the Stipulated Final Order below; (vi) she states that no promises or representation has been 28 made to induce him to sign this Stipulation and Final Order; and (vii) she has consulted with an 29 attorney regarding this Stipulation and Final Order and has been fully advised with regard to her 30 rights thereto, or waives any and all rights to consult with an attorney prior to entering into this Page 1 STIPULATION OF FACTS, AND DENIAL OF RIGHT TO APPLY -- RAHIM 1 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. On or about February 8, 2006, Rahim signed and submitted a PA-1 form as part of , 7 her application for a student teaching license, upon which she responded “no” to all 8 character questions. As part of the licensing process the Commission conducted a 9 routine background check and found Rahim had a criminal history. On August 16, 10 2005 Rahim was convicted of Theft in the tst Degree, Identity Theft (3 counts), 11 Forgery (2 counts) and Possession of Forged Instrument (2 counts). These 12 convictions stemmed from Rahim’s involvement in an operation that defrauded retail 13 stores by stealing credit card numbers and phoning in orders to pickup consumer 14 goods that were later returned for cash. Rahim was ordered to pay restitution of 15 $14,524 and was placed on five years of supervised probation. On October 17, 16 2005 Rahim was convicted in the state of Virginia for multiple counts of Fraud, 17 Forgery, and Identity Theft stemming from similar criminal activity. Though r 18 physically in Virginia and Oregon during the commission of these crimes, Rahim 19 was involved in defrauding stores in Texas, Arizona, Georgia, New Jersey, Illinois, 20 and Arkansas. Rahim should have answered "yes" to the following questions: 21 a. #8. Have you ever been convicted or been granted conditional discharge by any 22 court for: a) any felony, ; b) misdemeanor; or c) any major traffic violation, such 23 as: driving under the influence of intoxicants or drugs; reckless driving; fleeing 24 from or attempting to elude a police officer; driving while your license was 25 suspended, revoked or used in violation of any license restrictions; or failure to 26 perform the duties of a river or witness to an accident? 27 b. #9. Have you ever been arrested or cited for any offense listed in questions (8) 28 above which is still pending in court? 29 c. #10. Have you ever entered a plea of guilty or No contest relative to any charge 30 of an offense listed in question 8? 31 2. On August 21, 2009 Rahim submitted a C-t Form for Educator Licensure, in support of Page 2 STIPULATION OF FACTS, AND DENIAL OF RIGHT TO APPLY -- RAHIM ‘ 1 her application for an Initial l Teaching License. On this form Rahim answered "yes" to 1 2 the questions which she previously answered "no" to on her PA-1 Form. 3 3. After submission of her C-1 Form, during conversations with Commission staff Rahim 4 explained that she did not have to disclose her criminal history because it could be 5 expunged. Each of Rahim’s responses provides independent grounds for 19 denial of her license application under OAR 584-050-0006(2)(a), which provides that a license 2O application may be denied if the applicant submits a falsified application. Each of Rahim’s 21 responses also violated OAR 584-020-0040(4)(c), which provides as follows “Knowing 22 falsification of any documents or knowing misrepresentation directly related to licensure, 23 employment, or professional duties," constitutes gross neglect of duty and is a basis for denial 24 of licensure, as it is incorporated in ORS 342.143, “good moral character."
