6 On or about July 5, 2011, the Teacher Standards and Practices Commission
7 (Commission) received information relating to Michael Edward Moore (Moore).
8 After review of the matters alleged, Moore and the Commission agree that their
9 respective interests, together with the public interest, are best served by a stipulation to certain
1 0 facts, and the imposition of the revocation 0f Moore’s right to apply for an Oregon Teaching
i 1 1 License.
‘ 12 This document sets forth the facts upon which the parties have agreed and the stipulated
I 1 3 sanction to be imposed. Moore stipulates that there is sufficient evidence in the Commission’s
14 files and records to support the findings of fact, conclusions of law, and order set forth below.
1 5 By signing below, Moore acknowledges, understands, stipulates, and agrees to the
16 following: (i) he has been fully advised of his rights to notice and a hearing to contest the
17 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all
18 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final
i 19 Order of Revocation of Right to Apply (Stipulation and Final Order); (ii) this Stipulation and
20 Final Order is a public document and disclosed to the public upon request by the Commission;
21 (iii) this Stipulation and Final Order is contingent upon and subject t0 approval and adoption by
22 the Commission. If the Commission does not approve and adopt this Stipulation and Final
23 Order, then neither Moore nor the Commission are bound by the terms herein; (iv) he has fully
24 read this Stipulation and Final Order, and understands it completely; (v) he voluntarily, without
25 any force or duress, enters into this Stipulation and Final Order and consents to issuance and
26 entry of the Stipulated Final Order below; (vi) he states that no promises or representation has
27 been made to induce him to sign this Stipulation and Final Order; and (vii) he has consulted
28 with an attorney regarding this Stipulation and Final Order and has been fully advised with
29 regard to his rights thereto, or waives any and all rights to consult with an attorney prior t0
3O entering into this Stipulation and Final Order and issuance and entry of the Stipulated Final
31 Order below. In entering into this stipulation, Moore waives the right to a hearing to contest the
32 findings of fact, conclusions of law and order set forth below.

1 STIPULATION OF FACTS
2 1. The Commission has licensed Michael Edward Moore since September 9, 2003. Moore
3 held a Five-Year Career and Technical Teaching License issued February 1, 2008, with
4 an endorsement in Mechanical Systems, which expired on October 18, 2011. During all
5 relevant times, Moore was employed by the North Wasco County School District.
6 2. On July 5, 2011, the Commission received a complaint from a patron indicating that
7 Moore may have violated professional standards. Upon learning of the complaint, TSPC,
8 the school district and local law enforcement each conducted investigations.
9 Investigations determined during the 2011 — 2012 school year, Moore attended social
1O events outside of school where Moore interacted with underage students and other
1 1 minors ,who were consuming alcohol. Witnesses reported Moore observed underage
12 students consuming alcohol. Moore failed to report or otherwise intervene regarding
13 these MIP activities.
14 3. Commission investigators determined, and Moore later confirmed that 0n or about May
15 12, 2011, Moore sent student MT an inappropriate text message. The text message was
1 6 in response to M00re’s belief that MT was spreading rumors about him having a
1 7 romantic relationship with another female student. Moore’s text message reads, “I don’t
18 point fingers Ill F@# (fuck) s@# (shit) up it better stop or everyones gunna (sic) suffer, 2
19 people confronted me today an (sic) said you were talking about it in class?”
20 Investigations by the school district, law enforcement, and TSPC were unable to
21 substantiate that Moore engaged in any romantic relationship with any student.

1 CONCLUSION OF LAW
2 Michael Edward Moore’s conduct described in sections two (2) and three (3) above
‘ 3 constitutes gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020-004O(4)(n) as
I 4 it incorporates OAR 584-020-001O(5) (Use professional judgment), OAR 584-020-0030(2)(b)
5 (Skill in communicating with administrators, students, staff, parents, and other patrons); and
6 OAR 584-020-004o(4)(o) as is incorporates OAR 584-020-0035(1)(c)(D) (Honoring
7 appropriate adult boundaries with students in conduct and conversation at all times).
8 The Commission’s authority to impose discipline in this matter is based upon ORS
9 342.175.

1 1 The Commission hereby adopts and incorporates herein the above stipulation of facts,
12 conclusions of law, and based thereon hereby imposes the revocation of Moore’s right t0 apply
13 for an Educator License to commence upon finalization of this order
