The Notice was sent via U.S. First Class Mail and U.S. 11 Certified Mail Receipt 7006 2760 0000 1638 6817 to the address Ms. White provided to the 12 Commission. The U.S. First Class Mail receipt was returned to the Commission on July 11, 2008, 13 signed by Ms. Lindsay. The Notice of Opportunity of Hearing, dated July 8, 2008, and signed by 14 Victoria Chamberlain, Executive Director, stated: ‘ 15 You, Lindsay Rae White, are entitled to a hearing on the proposed action of the 16 Commission. If you want a hearing, you must file a written request for a hearing with 17 the Commission within 21 days of the date of this notice. Attached to this notice is a 18 copy of the procedures. right of representation and other rights of parties relating to the 19 conduct of a hearing as required under ORS 183.413(2). 5(1) Ms. White did not request a hearing. The Commission, therefore, finds Ms. White to be in 22 default and enters the following findings of fact, conclusions of law and order, based on the 23 files and records of the Commission concerning this matter. ‘ 24 FINDINGS OF FACT 25 1. During the 2006-2007 school year while working for the Hillsboro School District you, while 26 intoxicated, called or sent a text message to student NM inviting her to a party at your home. This 27 conduct constitutes gross neglect of duty in violation of OAR 584»020-0040(4)(o) as it 28 incorporates OAR 584020-0035(1)(c)(D). Following your invitation, student NM attended this party at your home. While NM was there 3 many of the individuals present consumed alcohol or dugs. Another student, DK, was also 4 present. This conduct constitutes gross neglect of duty in violation of OAR 584-020-0040(4)(o) as s it incorporates OAR 584-020-0035(1)(c)(D). (Honoring appropriate adult boundaries with students 6 in conduct and conversations at all times), OAR 584-020-0040(4)(n) (“Substantial deviation from 7 professional standards of competency set forth in OAR 584-020-0010 through 584-020-0030”), as 8 it incorporates OAR 584-020-0010(5) (“Use professional judgment”). 9 3. Some time during the party, you engaged in kissing and other sexual contact (making out) with 10 student DK. You subsequently went into your room with DK and closed the door, where you 11 remained for approximately 15 minutes. This conduct constitutes gross neglect of duty in 12 violation of OAR 584-020-0040(4)(f). (Any sexual conduct with a student as defined in OAR 584- 13 020-0005(5)(a) to (d), OAR 584-020-0040(4)(o), as it incorporates OAR 584-020-0035(1)(c)(D). 14 (Honoring appropriate adult boundaries with students in conduct and conversations at all times), 15 OAR 584-020-0040(4)(n) (“Substantial deviation from professional standards of competency set 16 forth in OAR 584-020-0010 through 584-020-0030”) as it incorporates OAR 584-020-0010(5) t7 (“Use professional judgment”). 18 CONCLUSIONS OF LAW 19 Ms. White failed to maintain an appropriate student teacher relationship. This conduct violates OAR 20 584-020-0040(4)(o), as it incorporates OAR 584-020-0035(1)(c)(D). Ms. White engaged in 21 inappropriate physical contact with a student. This conduct constitutes Gross Neglect of Duty as it 22 incorporates OAR 584-020-0040(4)(f).
