1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF REINSTATEMENT 5 LEONARD DEAN HACKETI' ) AND PROBATION 6 On or about May 30, 2008, the Teacher Standards and Practices Commission 7 (Commission) received an application for reinstatement of a revoked Initial I Teaching License 8 from Leonard Dean Hackett (Hackett). Hackett answered affin'natively to character questions 1, 9 2, 3, 4, 5 and 7. Hackett submitted a personal affidavit and recommendations of support to 10 establish that he has the qualifications required for reinstatement of his license. 11 After review of this matter, Hackett and the Commission agree that their respective 12 interests, together with the public interest, are best served by a stipulation to certain facts and 13 the imposition of four (4) years probation. 14 This document sets forth the facts upon which the parties have agreed and the 15 stipulated sanction to be imposed. Hackett stipulates that the TSPC has the statutory authority 16 to rely upon these facts to support this order and he will not contest this order. 17 By signing below, Hackett acknowledges, understands, stipulates, and agrees to 18 the following: (i) he has been fully advised of his rights to notice and a hearing to 19 contest the findings of fact, conclusions of law, and order set forth below, and fully and 20 finally waives all such rights and any rights to appeal or otherwise challenge this 21 Stipulation of Facts, Order of Reinstatement and Probation (Stipulation and Final 22 Order); (ii) this Stipulation and Final Order is a public document and disclosed to the 23 public upon request by the Commission; (iii) this Stipulation and Final Order is 24 contingent upon and subject to approval and adoption by the Commission. If the 25 Commission does not approve and adopt this Stipulation and Final Order, then neither 26 Hackett nor the Commission are bound by the terms herein; (iv) he has fully read this Page 1 STIPULATION OF FACTS, ORDER OF REINSTATEMENT AND PROBATION - HACKETT 1 Stipulation and Final Order, and understands it completely; (v) he voluntarily enters into 2 this Stipulation and Final Order and consents to issuance and entry of the Stipulated 3 Final Order below; (vi) he has consulted with an attorney regarding this Stipulation and 4 Final Order and has been fully advised with regard to his rights thereto, or waives any 5 and all rights to consult with an attorney prior to entering into this Stipulation and Final 6 Order and issuance and entry of the Stipulated Final Order below. 7 STIPULATION OF FACTS 8 1. The Commission has licensed Mr. Hackett beginning August 30, 2004. Mr. 9 Hackett last held an Initial I Teaching license with endorsements in Multiple Subjects at 10 the Middle Level and Social Studies at the high school and middle levels, issued 11 November 11, 2005, which expired August 4, 2006. 12 2. On April 18, 2006, the Commission received a report from the Salem-Keizer 13 School District indicated that Mr. Hackett used his school computer to access sexually 14 explicit materials. On August 4, 2006 the Commission suspended Mr. Hackett’s license 15 for a period of 90 days and imposed a four (4) year probation for this conduct. 16 3. On or About April 17, 2007, Mr. Hackett signed and submitted an Application 17 for Educator License form C-1 seeking to reinstate his license. On November 5, 2007 18 the Commission denied Mr. Hackett's application for reinstatement, for failure to 19 establish fitness to serve as an educator. 20 l/ l 21 l/ I 22 l // 23 / // 24 // I Page 2 STIPULATION OF FACTS, ORDER OF REINSTATEMENT AND PROBATION - HACKETI' 1 4. On or about April 17, 2008, Mr. Hackett submitted a complete application and 2 evidence of his fitness to serve as an educators as required by OAR 584-050-0018(4). 3 IT IS SO STIPULATED: 4 £QZMA /® Ibkkfilg I'O’QQ'OS 5 Leonard Dean Hackett Date 6 . 7 @égM/QZM mac-01> 8 Victoria C n, Executive Director Date 9 Teacher Standards and Practices Commission 10 CONCLUSION 0F LAW 11 Leonard Hackett provided sufficient evidence to establish convincingly that he 12 possesses the qualifications required for reinstatement of his Standard Teaching 13 License pursuant to OAR 584-050-0018(4). 14 ORDER 15 The Initial I Teaching License of Leonard Dean Hackett is hereby reinstated 16 subject to conditions. 17 Furthermore, the Commission imposes a four (4) year probation upon Mr. 18 Hackett subject to the following terms and conditions: 19 1. Mr. Hackett shall, at his own initiative and expense, continue his current 20 treatment program for addiction as recommended by his counselor 21 2. During the period of his probation, Mr. Hackett shall submit to the Executive 22 Director of the Commission reports of his continued attendance at his 12-step support 23 program. Mr. Hackett shall provide these reports every six (6) months during his 24 probation.
