1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 TYSON LANGFORD ) AND PROBATION 6 On or about August 31, 2007, the Teacher Standards and Practices Commission 7 (Commission) received an application for an Initial l Technical License from Tyson Langford. A review 8 of the application materials reveals that that he was convicted of Aggravated Theft l on July 9, 2007. 9 Mr. Langford fully cooperated with the Commission's investigation. After review of the matters 10 alleged, Mr. Langford and the Commission agree that their respective interests, together with the 11 public interest, are best served by a stipulation to certain facts, the imposition of a Public Reprimand 12 and a four (4) year probation. 13 This document sets forth the facts upon which the parties have agreed and the stipulated 14 sanction to be imposed. Mr. Langford stipulates that there is sufficient evidence in the Commission’s 15 files and records to support the findings of fact, conclusions of law, and order set forth below. 16 By signing below, Mr. Langford acknowledges, understands, stipulates, and agrees to the 17 following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of 18 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any 19 rights to appeal or otherwise challenge this Stipulation of Facts, Final Order of Reprimand and 20 Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and 21 disclosed to the public upon request by the Commission; (iii) this Stipulation and Final Order is 22 contingent upon and subject to approval and adoption by the Commission. If the Commission does 23 not approve and adopt this Stipulation and Final Order, then neither Mr. Langford nor the Commission 24 are bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and understands 25 it completely; (v) he voluntarily, without any force or duress, enters into this Stipulation and Final 26 Order and consents to issuance and entry of the Stipulated Final Order below; (vi) he states that no 27 promises or representations have been made to induce him to sign this Stipulation and Final Order; Page 1 - STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND AND PROBATION - LANGFORD 1 and (vii) he has consulted with an attorney regarding this Stipulation and Final Order and has been 2 fully advised with regard to his rights thereto, or waives any and all rights to consult with an attorney 3 prior to entering into this Stipulation and Final Order and issuance and entry of the Stipulated Final 4 Order below. This Order sets forth the facts upon which the parties have agreed and the sanction to 5 be imposed. Mr. Langford stipulates that there are sufficient facts contained in the Commission's files 6 and records to support the findings of fact and conclusions of law set forth below. In entering into this 7 stipulation, Mr. Langford understands that the probation will be subject to specific terms and 8 conditions. 9 STIPULATION OF FACTS 10 1. On August 31, 2007 Mr. Langford submitted an application for an Initial I Teaching License, 11 with an endorsement in Computer Technology. The Commission has not previously licensed 12 Mr. Langford. 13 2. On July 9, 2007, Mr. Langford was convicted of Aggravated Theft I in Multnomah County 14 Circuit Court. Mr. Langford diverted funds while working in the accounting department of an 15 Oregon Holiday Inn. 16 3. Mr. Langford was ordered t0 pay the money back and complete community service. 17 4. Mr. Langford is a graduate of Concordia University's teacher education program. Mr. Langford 18 did not tell Concordia of his arrest and conviction. FINAL ORDER OF REPRIMAND AND PROBATION - LANGFORD 1 CONCLUSIONS OF LAW 2 On July 9, 2007 Mr. Langford was convicted of Aggravated Theft I for diverting funds while 3 working in the accounting department of an Oregon Holiday Inn. This conduct constitutes Gross 4 Neglect of Duty in violation of OAR 584-020-0040(4)(o) as it incorporates OAR 584-020-0035(3)(a). 5 The Commission has authority to impose discipline in this matter under ORS 342.120 through 6 342.430 and OAR Chapter 584. 7 ORDER 8 The Commission adopts and incorporates herein the above finding of facts, conclusions of 9 law, and based thereon, hereby imposes a Public Reprimand upon Tyson Langford's Initial I Teaching 10 License which will be issued following the Commission's approval of this Final Order.
