HACKE'IT ) SURRENDER AND REVOCATION 6 ) 7 8 On or about March 17, 2016, the Teacher Standards and Practices Commission 9 (Commission) received a report from the Oregon Department of Human Services, indicating 1O that licensed educator, Steven T. Hackett (Hackett), had committed acts of unprofessional 1 1 conduct. On May 9, 2016, the Commission received a report from the Medford School District, 12 indicating that Hackett was the subject of a local law enforcement investigation alleging that 1 3 Hackett had engaged in sexual contact with an eighteen-year-old student, and Hackett had 14 provided the student with marijuana and alcohol. 15 Alter review of the matters alleged, Hackett and the Commission agree that their 16 respective interests, together with the public interest, are best served by a stipulation to certain 17 facts, Hackett’s surrender of his Oregon educator license and the consequent revocation of 18 Hackett’s Oregon educator license. 19 By signing below, Hackett acknowledges, understands, stipulates, and agrees to the 20 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 21 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 22 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 23 Order of Surrender and Revocation (Stipulation and Final Order); (ii) this Stipulation and Final 24 Order is a public document and disclosed to the public upon request by the Commission; (iii) 25 this Stipulation and Final Order is contingent upon and subject to approval and adoption by the 26 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, 27 then neither Hackett nor the Commission are bound by the tenns herein; (iv) he has fully read 28 this Stipulation and Final Order, and understands it completely; (v) he voluntarily, without any Page 1 STIPULATION OF FACTS AND FINAL ORDER OF SURENDER AND REVOCATION- STEPHEN T. HACKETT 1 force or duress, enters into this Stipulation and Final Order and consents to issuance and entry 2 of the Stipulated Final Order below; (vi) he states that no promises or representation has been 3 made to induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an 4 attorney regarding this Stipulation and Final Order and has been fully advised with regard to his 5 rights thereto, or waives any and all rights to consult with an attorney prior to entering into this 6 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 7 This Order sets forth the facts upon which the parties have agreed and the sanction to be 8 imposed. Hackett stipulates that there are sufficient facts contained in the Commission’s files 9 and records to support the findings of fact and conclusions of law set forth below. In entering 1O into this stipulation, Hackett waives the right to a hearing to contest the findings of fact, 1 1 conclusions of law and order set forth below. 12 STIPULATION OF FACTS 13 1. The Commission has licensed Hackett since August 16, 2006. Hackett currently holds a 14 Professional Teaching License, with an endorsement in Special Education: Generalist 15 (PK-12), valid December 7, 2015, through May 19, 2021. During all relevant times, 1 6 Hackett was employed by the Medford School District. 17 2. On March 17, 2016, the Commission received information from the Oregon Department 18 of Human Services (DHS), indicating that licensed educator, Steven T. Hackett 1 9 (Hackett), had committed acts of unprofessional conduct. On May 9, 2016, the Medford 20 School District reported to the Commission that Hackett was the subject of a local law 21 enforcement investigation and may have committed acts which constitute gross neglect 22 of duty as related to the initial report from DHS. 23 3. Commission investigators learned that on March 30, 2016, Hackett was issued a criminal 24 citation for four counts of Official Misconduct in the First Degree and one count of 25 Furnishing Alcohol to a Minor. Hackett resigned his employment with the Medford 26 School District effective April 15, 2016. Page 2 STIPULATION OF FACTS AND FINAL ORDER OF SURENDER AND REVOCATION- STEPHEN T. HACKETT 1 4. Investigation determined that on August 18, 2016, Hackett entered into a plea agreement 2 and related judgment that resulted in Hackett being convicted of Official Misconduct in 3 the First Degree. Hackett engaged in unprofessional conduct as described in section three (3) 17 above. This conduct constitutes Gross Unfitness in violation of OAR 584-020-oo4o(5)(e) 18 (Admission of or engaging in acts constituting criminal conduct, even in the absence of a 19 conviction), specifically: ORS 162.415 (Oflicial Misconduct in the First Degree). 20 Stephen T. Hackett engaged in unprofessional conduct as described in section four (4) 21 above. This conduct constitutes Gross Neglect of Duty in violation of ORS 342.175(1)(b); OAR 22 584-020-0040(4)(n) as it incorporates OAR 584-020-001o(5) (Use professional judgment), 23 OAR 584-020-0025(2)(e)( Using district lawful and reasonable rules and regulations); OAR 24 584-020-oo4o(4)(o) as it incorporates OAR 584-020-0035(1)(b)(Refiain from exploiting 25 relationships with any student for personal gain, or in support of persons or issues), OAR 584- 26 020-0035(1)(c)(A) (Not demonstrating or expressing professionally inappropriate interest in a 27 students personal life), OAR 584-020-0035(1)(c)(B) (Not accepting or giving or exchanging Page 3 STIPULATION OF FACTS AND FINAL ORDER OF SURENDER AND REVOCATION~ STEPHEN T. HACKETT 4—____— 1 romantic or overly personal gifts 0r notes with a student); OAR 584-020-0035(1)(c)(D) 2 (Honoring appropriate adult boundaries with students in conduct and conversations at all 3 times); and OAR 584-020-0040(4)(i) (Any sexual conduct with a student). The Commission 4 may rely on the definitions of sexual conduct in ORS 339.37O(9) and OAR 584-02O-Ooo5(5). 5 The Commission’s authority to impose discipline in this matter is based upon ORS 6 342.175. 7 ORDER 8 The Commission adopts the above Stipulation of Facts and Final Order and accepts 9 Stephen T.
