1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION .2 OF THE STATE OF OREGON 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF 6 KYLE AARON WOODRUFF ) LICENSE REVOCATION 7 On May 23, 2006, the Teacher Standards and Practices Commission (Commission) 8 Issued a Notice of Opportunity for Hearing to Kyle Aaron Woodruff (Woodruff) in which the 9 Commission charged him with misconduct under OFIS 342.175. The Notice was sent via U.S. |0 First Class Mail and U.S. Certified Mail Receipt 7005 0390 0005 5794 9238 to the address Mr. I l Woodruff provided to the Commission on his application for licensure. The certified mail receipt 12 was signed by Mr. Woodruff and returned to the Commission on June 2, 2006. The Notice of l3 Opportunity of Hearing, dated May 23, 2006, and signed by Victoria Chamberlain, Executive 14 Director, stated: 15 "You, Kyle Aaron Woodruff, are entitled to a hearing on the proposed action of 16 the Commission. If you want a hearing, you must file a written request for a Q hearing with the Commission within 21 days of the date 0t this notice. Attached to this notice is a copy of the procedures, right of representation and other rights 19 of parties relating to the conduct of a hearing as required under ORS 20 183.413(2)." 2l 22 Mr, Woodruff did not request a hearing. The Commission, therefore, finds 23 Mr. Woodruff to be in default and enters the following findings of fact, conclusions of law 24 and order, based on the files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. On January 12, 2006, Mr. Woodruff applied fora Transitional Teaching License and 27 responded “no” to all character questions. 28 2. The Commission issued a Transitional Teaching License to Mr. Woodruft on 29 Februan/ 15, 2006, valid until February 15, 2009, with Biology, Chemistry, Integrated Science, 30 Multiple Subjects and Physics Endorsements. 31 3. Mr. Woodrutf registered with the Malhuer ESD to serve as a substitute teacher. Q 4. On or about February 23, 2006, the Commission received information indicating that PAGE 1 — DEFAULT ORDER OF LICENSE REVOCATION — KYLE AARON WOODRUFF 1 Mr. Woodruft failed to disclose, on an application for Iicensure submitted to the Commission, '2 that he held a teaching license issued by the State of Wyoming and that he served as a licensed 3 teacher for Lincoln County School District, Afton, Wyoming, from August 18, 2005, through 4 December 22, 2005. 5 5. Documents from the Lincoln County School District, Afton, Wyoming indicate that Mr. 6 Woodruff resigned in lieu of termination from his teaching position at Cokeville High School, 7 Lincoln County School District, Afton, Wyoming on December 22, 2005, in response to a District 8 investigation regarding misconduct. The investigation revealed that Mr. Woodruff‘s classroom 9 computer at Cokeville High School had been used to access sexually explicit Internet sites and 10 down load inappropriate video clips. Mr. Woodrutf failed to complete his 2005-2006 contract for 11 employment. 12 6. On January 12, 2006, Mr. Woodruft failed to respond affirmatively, on Application For 3 Educator Licensure Form C-1, to character question 1, “Have you ever left any educational or Q1 school-related employment...while the subject of an inquiry, review or investigation of alleged 15 misconduct..." and character question 3, “Have you ever failed to complete a contract tor 16 educational services in any educational or school-related position...” 17 CONCLUSIONS OF LAW i: Kyle Aaron Woodruff’s failure to provide information regarding a prior employer and to 20 respond appropriately to character questions constitute knowing misrepresentation directly 21 related t0 Iicensure in violation of OAR 584-020-0040(4)(c). This misconduct constitutes Gross 22 Neglect of Duty.
