1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACI‘ S, 4 Teaching License of ) SURRENDER AND REVOCATION 5 PARRA, BYRON KELVIN ) OF LICENSURE 6 On 0r about April 23, 2012, the Teacher Standards and Practices Commission i 7 (Commission) received a report from the Springfield School District, indicating that licensed 8 educator, Byron Parra (Parra), had committed acts of unprofessional conduct. Specifically, Parra 9 had been charged, and on October 15, 2012, plead guilty to the Misdemeanor crime of 1O “Furnishing Liquor t0 a Minor". 1 1 After review of the matters alleged, Parra and the Commission agree that their respective 12 interests, together with the public interest, are best served by a stipulation to certain facts, 13 Surrender and Revocation of Parra’s Oregon Teaching License. 14 This document sets forth the facts upon which the parties have agreed and the stipulated 15 sanction to be imposed. Parra stipulates that there is sufficient evidence in the Commission's 16 files and records to support the findings of fact, conclusions of law, and order set forth below. 17 By signing below, Parra acknowledges, understands, stipulates, and agrees to the 18 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 19 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 20 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 21 Order of Surrender and Revocation of Licensure (Stipulation and Final Order); (ii) this 22 Stipulation and Final Order is a public document and disclosed to the public upon request by the 23 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to approval 24 and adoption by the Commission. If the Commission does not approve and adopt this 25 Stipulation and Final Order, then neither Parra nor the Commission are bound by the terms 26 herein; (iv) he has fully read this Stipulation and Final Order, and understands it completely; (v) 27 he voluntarily, without any force or duress, enters into this Stipulation and Final Order and Egififliq STIPULATION OF FACTS, ORDER OF SURENDER AND REVOCATION — PARRA, BYRON 1 consents to issuance and entry of the Stipulated Final Order below; (vi) he states that no 2 promises or representation has been made to induce him to sign this Stipulation and Final 3 Order; and (vii) he has consulted with an attorney regarding this Stipulation and Final Order 4 and has been fully advised with regard to his rights thereto, or waives any and all rights to 5 consult with an attorney prior to entering into this Stipulation and Final Order and issuance and 6 entry of the Stipulated Final Order below. This Order sets forth the facts upon which the parties 7 have agreed and the sanction to be imposed. Parra stipulates that there are sufficient facts 8 contained in the C0mmission’s files and records to support the findings of fact and conclusions 9 of law set forth below. In entering into this stipulation, Parra waives the right to a hearing to 1O contest the findings of fact, conclusions of law and order set forth below. 1 1 STIPULATION OF FACTS 12 1. The Commission has licensed Parra since January 15, 2008. Parra currently holds an 1 13 Initial I Teaching License with endorsements in Multiple Subjects (MIDLVL) and i 14 Advanced Mathematics (I-IS, ML), issued December 8, 2011, and expires on December 7, 15 2014. On October 15, 2012, Parra submitted a letter to TSPC surrendering his teaching 16 license as part of a criminal court resolution. During all relevant times, Parra was 1 7 employed by the Springfield School District. 18 2. On April 23, 2012, the Commission received a school district report indicating Parra may 1 9 have committed acts which constitute gross neglect of duty. Upon learning of the 20 complaint, TSPC, the school district and local law enforcement each conducted 21 investigations. Investigations determined that during the summer between the 2010 - 22 2011 and 2011 — 2012 school years, Parra furnished an alcoholic beverage to a minor 23 aged student, off school premises. i 24 3. Local law enforcement arrested and charged Parra with three counts of the misdemeanor 25 crime “Furnishing Liquor to a Minor”. On October 11, 2012, Parra pled guilty to one t 26 count of Furnishing Liquor to a Minor and was sentenced to three years probation, fined, i i1265-312"!STIPULATION OF FACTS, ORDER OF SURENDER AND REVOCATION — PARRA, BYRON 1 ordered to serve community service, trespassed from school district properties, and 2 ordered to surrender his teaching certificate. 3 IT IS SO STIPULATED: 4 é- 4,1’ 11/18/2013 5 Byr ‘6:1; rra T - Dm——— e /M¢/@// " [1628312 7 Victoria Cham e xecutive Director Date 8 Teacher Standards and Practices Commission 9 CONCLUSION OF LAW 1O Byron Parra engaged in unprofessional conduct as described in section two (2) above. 1 1 This conduct constitutes Gross Neglect of Duty in violation of ORS 342.175(1)(b); OAR 584-020- 12 oo4o(4)(n) as it incorporates OAR 584-020-0010(5) (Use professional judgment), OAR 584- 13 ozo-oo4o(4)(o) as is incorporates OAR 584-020-0035(1)(c)(D) (Honoring appropriate adult 14 boundaries with students in conduct and conversation at all times); and OAR 584-020- 15 0035(3)(a) (Maintain the dignity of the profession by respecting and obeying the law, l 16 exemplifying personal integrity and honesty). i 17 Byron Parra engaged in unprofessional conduct as described in section three (3) above. 18 This conduct constitutes Gross Neglect of Duty in violation of ORS 342.175(1)(b); OAR 584-020- 19 0040(4)(n) as it incorporates OAR 584-020-0010(5) (Use professional judgment). This conduct 20 also constitutes gross unfitness in violation of ORS 342.175(1)(c); OAR 584-020-0040(5)(c) 21 (Conviction of violating any federal, state, or local law.
