1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 SHELLEY LYNN TILDON ) AND PROBATION 6 On or about September 28, 2007 the Teacher Standards and Practices Commission 7 (Commission) received an application for a Three Year Professional Technical License with an 8 endorsement in Computer Technology from Shelley Tildon. A review of the application materials 9 reveals that that she was convicted of Theft I in 1999. 1O Ms. Tildon fully cooperated with the Commission's investigation. After review of the matters 11 alleged, Ms. Tildon and the Commission agree that their respective interests, together with the public 12 interest, are best served by a stipulation to certain facts, the imposition of a Public Reprimand and a 13 four (4) year probation. 14 This document sets forth the facts upon which the parties have agreed and the stipulated 15 sanction to be imposed. Ms. Tildon stipulates that there is sufficient evidence in the Commission's 16 files and records to support the findings of fact, conclusions of law, and order set forth below. . 17 By signing below, Ms. Tildon acknowledges, understands, stipulates, and agrees to the 18 following: (i) she has been fully advised of her rights to notice and a hearing to contest the findings of 19 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any 20 rights to appeal or otherwise challenge this Stipulation of Facts, Final Order of Suspension and 21 Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and 22 disclosed to the public upon request by the Commission; (iii) this Stipulation and Final Order is 23 contingent upon and subject to approval and adoption by the Commission. If the Commission does 24 not approve and adopt this Stipulation and Final Order, then neither Ms. Tildon nor the Commission 25 are bound by the terms herein; (iv) she has fully read this Stipulation and Final Order, and 26 understands it completely; (v) she voluntarily, without any force or duress, enters into this Stipulation 27 and Final Order and consents to issuance and entry of the Stipulated Final Order below; (vi)lshe Page 1 » STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND AND PROBATION - TILDON 1 states that no promises or representation has been made to induce her to sign this Stipulation and 2 Final Order; and (vii) she has consulted with an attorney regarding this Stipulation and Final Order 3 and has been fully advised with regard to her rights thereto, 0r waives any and all rights to consult 4 with an attorney prior to entering into this Stipulation and Final Order and issuance and entry of the 5 Stipulated Final Order below. This Order sets forth the facts upon which the parties have-agreed and 6 the sanction to be imposed. Ms. Tildon stipulates that there are sufficient facts contained in the 7 Commission's files and records to support the findings of fact and conclusions of law set forth below. 8 In entering into this stipulation, Ms. Tildon understands that the probation will be subject to specific 9 terms and conditions. 1O STIPULATION OF FACTS 11 1. On August 22, 2007 Ms. Tildon submitted an application for a Three- Year Career and 12 Technical EducationTeaching License, with an endorsement in Computer Technology. The 13 Commission has not previously licensed Ms. Tildon. 14 2. On August 30, 1999, Ms. Tildon was convicted of Theft I in Coos County Circuit Court. Ms. 15 Tildon, , diverted funds to pay for personal expenses in her position as union treasurer. 16 3. M 4mm 23 |ctoria Cha - =53, Executive Director Date 24 Teacher Standards and Practices Commission 25 III 26 / / / Page 2 - STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND AND PROBATION - TILDON 1 CONCLUSIONS OF LAW 2 On August 30, 1999 Ms. Tildon was convicted for Theft I for diverting funds during her tenure 3 as union treasurer. This conduct constitutes Gross Neglect of Duty in violation of OAR 584020- 4 0040(4)(o) as it incorporates OAR 584-020-0035(3)(a). The Commission has authority to impose 5 discipline in this matter under ORS 342.120 through 342.430 and OAR Chapter 584. 6 ORDER 7 The Commission adopts and incorporates herein the above finding of facts, conclusions of 8 law, and based thereon, hereby imposes a Public Reprimand upon Shelley Lynn Tildon‘s Three Year 9 Career and Technical Education Teaching License which will be issued following the commission's 10 approval of this Final Order.
