8 On September 20, 2011, the Teacher Standards and Practices Commission (Commission)

9 issued a Notice of Opportunity for Hearing to Dana Lynn Reis (Reis) in which the Commission
10 charged her with Gross Neglect of Duty pursuant to ORS 342.175(1)(b); OAR 584-020-
11 oo4o(4)(n) , OAR 584-020-oo1o(5) , OAR 584-020-0025(2)(e), OAR 584-020-0035(2)(c),
12 OAR 584-020-0040(4)(c). The Notice was sent via U.S. First Class Mail and U.S. Certified Mail
13 Receipt 7010 022780 0000 2187 6959 to the address on file with the Commission. Neither the
14 Certified Mail was returned as unclaimed. The Regular Mail was not returned and therefore
15 assumed delivered. The Notice of Opportunity of Hearing, dated September 2o, 2011, and
l6 signed by Victoria Chamberlain, Executive Director, stated:
l7 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD,
18 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR
19 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL.
20 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A
21 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY
22 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER
23 DISCIPLINE.“

25 Reis did not request a hearing. The Commission, therefore, finds Reis to be in default and
26 enters the following findings of fact, conclusions of law and order, based 0n the files and records
27 of the Commission concerning this matter.
28 FINDINGS OF FACT
29 1. Reis has been licensed as a teacher in Oregon since November 29, 2007. Her Initial I
30 Teaching License, with Basic Early Childhood Education and Standard Elementary
31 endorsements, issued on November 29, 2007, expired on May 29, 2009. During all relevant
32 times, Reis was employed by the Seaside School District.
33 2. During the 2008/2009 school year Reis did not instruct, score, or record required student
34 work samples for her fifth grade class. When asked about her maintenance of student
35 information, Reis was untruthful with school administration.

1 CONCLUSIONS OF LAW
2 Dana Lynn Reis’s failure appropriately maintain student grades and information
3 constitutes gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-o2o-oo4o(4)(n) as
4 it incorporates OAR 584-020-oo1o(5) (Use professional judgment), OAR 584-020-0025(2)(e)
5 (Using district lawful and reasonable rules and regulations); OAR 584-020-0040(4)(o) as it
6 incorporates OAR 584-020-0035(2)(c) (Using and maintaining student records as required by
7 federal and state law and district policies and procedures); and OAR 584-020-0040(4)(c)
8 (Knowing falsification of any document or knowing misrepresentation directly related to
9 licensure, employment, or professional duties).
10 The Commission’s authority to impose discipline in this matter is based upon ORS
11 342.175.
12 FINAL ORDER
13 The Commission suspends the right of Dana Lynn Reis to apply for a teaching or
14 administrative license, or charter school registry in Oregon for one year.
