OF THE STATE OF OREGON i 3 In the Matter of the ) . 4 Licensure of ) DEFAULT ORDER OF f 5 LINDA SUE DEYOUNG ) DENIAL OF LICENSURE ; 6 ) 7 8 On May 20, 2003, the Teacher Standards and Practices Commission issued a Notice 1 9 of Opportunity for Hearing to Linda DeYoung, in which the Commission proposed to deny 10 reinstatement of a license under ORS 342.135 and its administrative rules implementing that 11 legal authority OAR 584-050-0006. The Notice was sent via U.S. First Class Mail and U.S. 12 Certified Mail Receipt #7002 3150 0004 3439 2322 to the address Ms. DeYoung provided to 13 the Commission. The notice sent via U.S. Certified Mail was returned to the Commission 14 “unclaimed” on June 18, 2003. The notice sent via U.S. First Class Mail was not returned and 15 therefore assumed delivered. Ms. DeYoung did not request a hearing. ‘ The Notice of Opportunity for Hearing, signed by Victoria Chamberlain, Executive l7 Director, stated: 18 If a request for hearing is not received within this 21-day period, your right to 19 hearing shall be considered waived unless your failure to request a hearing was 20 beyond your reasonable control. If you do not request a hearing or if you fail to 21 appear at a hearing, the Commission will uphold the denial of your application for 22 reinstatement of an Oregon teaching license. 23 24 Based on the foregoing, the Commission finds Linda DeYoung in default and such 25 default is hereby entered. Based on the records and files of the Commission, the Commission 26 enters the following findings of fact, conclusions of law and order. 27 FINDINGS 0F FACT 28 1. Ms. DeYoung held a Temporary Three-Year Special Vocational Teaching License 29 with the Commission from March 21, 1991 to March 21, 1993. License Form C-1 requesting reinstatement of a Temporary Three-Year Professional Technical 3 Teaching License. The Temporary Three-Year Professional Technical Teaching License no 4 longer exists 5 3. Under current rules, Ms. DeYoung must submit passing scores on the basic skills 6 exam and a copy of a certificate verifying completion of a workshop on the laws prohibiting 7 discrimination for the Three-Year Professional Technical Teaching License. 8 CONCLUSIONS OF LAW 9 Ms. DeYoung‘s application for reinstatement of Temporary Three-Year Professional 10 Technical Teaching License is denied as she has not satisfied the necessary academic 11 requirements for reinstatement pursuant to OAR 584-042-0006.
