l NOTICE OF OPPORTUNITY FOR HEARING 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the Teaching ) STIPULATION OF FACTS License of ROBERT ALAN HUDDLESTON ) AND ORDER OF 4 ) REVOCATION 5 The Teacher Standards and Practices Commission (Commission) 6 issued a Notice of Opportunity for Hearing on January 30, 1997, 7 proposing to revoke the right of Robert Alan Huddleston 8 (Huddleston) to apply for reinstatement of his Oregon teaching 9 license. Huddleston requested a hearing to contest the 10 allegations in the notice. After a review of the matters 11 alleged, the parties have agreed that their respective interests, 12 together with the public interest, are best served by a 13 stipulation to certain facts and the imposition of an order ‘ 14 revoking Huddleston’s right to apply for reinstatement of his t 15 teaching license. This agreement sets forth the facts upon which 16 the parties have agreed, the sanction to be imposed and the basis 17 for the Commission's order. 18 STIPULATED FACTS 19 Huddleston and the Commission stipulate to the following 20 facts: 21 1. Huddleston held an Oregon teaching license that expired 22 on June 21, 1996. He was employed as a teacher with the Salem- 23 Keizer School District from 1977 until January 26, 1996. 24 2. On October 31, 1995, Huddleston was arrested and 25 subsequently charged with the offense of Criminal Mistreatment in 26 the First Degree based upon an allegation that Huddleston PAGE l —STIPULATION OF FACTS AND ORDER OF REVOCATION 177 DEPARTMENT 0F JUSTICE ‘éiifiéiiifigifi' (5093184620 1 intentionally or knowingly caused physical injury to J.G., a nine . 2 year old son of Huddleston's domestic partner. 3 3. On November 4, 1996, Huddleston entered a guilty plea 4 in Marion County Circuit Court to the charge of Criminal 5 Mistreatment in the First Degree, a Class C Felony. As a result, 6 the court imposed a sentence of 9O days in the Marion County jail 7 and placed Huddleston on supervised probation for a period of 36 8 months subject to the conditions that he abstain from the use of 9 intoxicants, that he have no contact with minors except as 10 approved by the Children's Services Division, that he participate 11 in and complete a counseling program through the Solutions 12 Treatment Program, and that he pay restitution of $1,500 for the 13 cost of counseling for J.G. and J.G.’s brother. 14 In entering this stipulation, Huddleston understands that . 15 the Commission will revoke his right to apply for reinstatement 16 of his teaching license as set forth more fully in the 17 Commission's order. This stipulation and the proposed order are 18 contingent on approval by the full Commission. If the Commission 19 does not approve this stipulation and proposed order as written, 20 it is understood that any waiver of rights by Huddleston is 21 therefore revoked. It is further understood that the statements 22 contained in this stipulation may not be used by either party for 23 any reason, should the Commission fail to approve this 24 stipulation and proposed order. 25 /// 26 /// . Myton Date / ' 6 Director, Teacher Standards and Practices Commission 7 8 CONCLUSION OF LAW 9 The conduct described in the foregoing stipulation 10 constitutes gross unfitness in violation of OAR 584-20-040(5). ll ORDER flAtk/Pursuant to ORS 342.175(l) and (3), . 12 / The Commission revokes the right of Robert Alan Huddleston 13 to apply for reinstatement of his Oregon Teaching License. If 14 Mr. Huddleston should apply for reinstatement at a future date, ’ 15 the decision would lie within the discretion of the Commissioners 16 who consider the matter at that time.
