'1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMIVIISSION 2 - t OF THE STATE OF OREGON v ' 3 In the Matter ofthe Case No. 115583 Teaching License of 4 SURRENDER OF LICENSE, STIPULATED 5 JASON LAIRD RODDICK ~ ORDER AND REVOCATION 6 The Teacher Standards and Practices (Commission) issued a Notice of Opportunity for 7 Hearing on January 6, 2004 to Jason Laird Roddick‘ The Notice was subsequently amended on 8 September 29, 2004, Mr‘ Roddick requested a hearing, and the case was assigned to 9 Administrative Law Judge Betty Smith and scheduled for hearing on October 27, 2004. 10 After a review of the matters alleged, the Commission and Mr Roddick have agreed that 11 their respective interests, together with the public interest, are best served by a stipulation to ‘2 certain facts, the surrender of Mr. Roddick’s teaching license and revocation of the license. l3 In entering into this stipulation, Mr. Roddick waives his right to a hearing and 14 understands that the Commission will accept the surrender of his teaching license and revoke the 15 license‘ This stipulation and proposed order are contingent on approval by the filll Commission. 16 If the Commission does not approve this stipulation and order, it is understood that any waiver of 17 rights by Mr. Roddick is therefore revoked. It is further understood that the statements contained 18 in this stipulation may not be used by either the Commission or Mr. Roddick for any reason if ‘ 19 the Commission fails to approve the stipulation and proposed order. i 20 STIPULATION OF FACTS 21 Mr. Roddick and the Commission stipulate as follows: 22 ' ‘3 Page I — STIPULATION AND ORDER — JASON LAIRD RODDICK — GENK5489.doc '1 1. Mr. Roddick holds an Oregon Standard Teaching License with endorsements in . 2 . standard integrated science, basic health integration, basic biology and basic chemistry. He has 3 been licensed in Oregon since 1997. 4 2. Mr. Roddick was employed as a teacher with the Dayton School District from S September 1997 to April 22, 2003 when was dismissed from his employment. He was also the 6 coach for the high school cheerleading squad. 7 3. In about 1998 or 1999, Mr. Roddick removed from school premises a laptop 8 computer owned by the Dayton School District without permission and took it to his home for 9 his personal use. Mr. Roddick kept the computer at his home until it was discovered by police in 10 March 2003. 11 4. In 2001, Mr. Roddick removed a television owned by the Dayton School District 2 from the Dayton High School without permission. He took the television to his own home for ‘3 his personal use. On June 16, 2003, Mr. Roddick was convicted of Theft in the Second Degree 14 in Yamhill County Circuit Court, as a result of his theft of the television. 15 5. During the 2002-3 school year, Mr. Roddick committed forgery by duplicating 16 toll cards for use on the Wheatland Ferry with intent to injure or defraud by using the falsely 17 made cards to ride on the ferry without paying the toll. Mr. Roddick used a copier owned by the 18 Dayton School District to duplicate the forged toll cards. On June 16, 2003, Mr. Roddick was 19 convicted of Forgery in the Second Degree in Yamhill County Circuit Court as the result of his 20 forgery of the toll cards. l 21 6. As a result of his convictions, Mr. Roddick was sentenced to two years’ i 22 probation, two days jail time, four days service on the county work crew, 20 hours of community ‘3 service, payment of restitution to the Dayton School District and a mental health evaluation. During the 2002-3 school year, Mr, Roddick duplicated and falsely made tickets 2 to a car wash, and he used the falsely made tickets to obtain car-wash services without paying for 3 them. 4 8. The Commission finds that Mr. Roddick failed to maintain an appropriate teacher- 5 student relationship with female students on the Dayton High School cheerleading squad during 6 the 2000-1 school year. Mr. Roddick failed to maintain appropriate boundaries in his 7 interactions with the students. During a school-sanctioned trip to Pendleton, Mr. Roddick stayed 8 late hours in the motel room of high school cheerleaders and lay with a female student and a 9 male student on a bed in the hotel room while watching a movie on television. Other students 10 were present at the time. Mr. Roddick Roddick stole a laptop computer belonging to the Dayton School 19 District. This conduct constitutes gross neglect of duty in violation of OAR 584-020- 20 0040(4)(a) and 584-020-0040(0) as it incorporates OAR 584-020-0035(2)(b) and 21 (3)(a). 22 2. Mr. Roddick stole a television belonging to the Dayton School District. He was 2 _ convicted of Theft in the Second Degree which constitutes gross unfitness in violation 3 of OAR 584-020-0040(5)(¢). 4 3. Mr. Roddick forged toll cards for use on the Wheatland Ferry in order to ride the 5 ferry without paying for the toll. This conduct constitutes gross neglect of duty in 6 violation of OAR 584-020-0040(o) as it incorporates OAR 584-020-0035(3)(a). He 7 was convicted of Forgery in the Second Degree which constitutes gross unfitness in 8 violation of OAR 584-020-0040(5)(c). 9 4. Mr. Roddick forged car-wash tickets in order to obtain car-wash services without 10 paying for them. This conduct constitutes gross neglect of duty in violation of OAR 11 584-020-0040(o) as it incorporates OAR 584-020-003 5(3)(a) and gross unfitness in 12 violation of OAR 584-020-0040(5)(c). ‘3 5. Mr. Roddick failed to maintain an appropriate teacher-student relationship with 14 female students from the Dayton High School.
