5 HEIDI LOUISE RAMOS ) ORDER OF REVOCATION
6 On or about March 21, 2006, the Teacher Standards and Practices Commission
7 (Commission) received a report from Dawn TarZIan Superintendent, Corvallis School District,
8 indicating that the District investigated allegations that Heidi Louise Ramos (Ramos) bit and
9 spanked a student in her classroom.
10 After review of the matters alleged, Ms. Ramos and the Commission agree that their
1 1 respective interests, together with the pubiic interest. are best served by a stipulation lo certain
12 facts ;nciuding the renunciation and surrender of her teaching license pursuant to OAR 584-050-
13 0027. Ms. Ramos agrees that the Commission has the authority to investigate the allegations
'i4 against her, make ‘Endings oir'act and sanctusions of law. ‘She does nct agree that the evidence
. supports aii ct the ‘Commission's findings and COFICELESIOHS oi law. Nonetheless, his. Ramos
16 understands that the Commission will rely upon these findings to revoke he: license and waives
17 her right to appeal the revocation of her license.
18 This document sets forth the facts upon which the parties have agreed and the
‘l9 stipulated sanction to be imposed. Ms. Ramos stipulates that the TSPC has the statutory
20 authority to rely upon these facts to support this order and she will not contest; this order.
21 By signing below, Ms. Ramos acknowledges, understands, stipulates, and agrees to the
22 io-Ziowing: (i) s'ne has been fuily advised other rights to notice and a hearing, to contest the
23 findings of fact, conclusions of law, and order set forth below, and futiy and t'inali'y waives all
24 such rights and any rights to appeal or othenmse challenge this Stipulation of Facts. Final Order
25 of Surrender and Suspension (Stipulation and Final Order); (ii) this Stipulation and Final Order is
26 a public document and disclosed to the public upon request by the Commission; (iii) this
.' Stipulation and Final Order is contingent upon and subject to approval and adoption by the

1 Commission. If the Commission does not approve and adopt this Stipulation and Final Order,
‘ then neither Ms. Ramos nor the Commission are bound by the terms herein; (iv) she has fully
3 read this Stipulation and Final Order, and understands it completely; (v) she voluntarily enters
4 into this Stipulation and Final Order consistent with her diversion agreement and consents to
5 issuance and entry of the Stipulated Final Order below; (vi) she has consulted with an attorney
6 regarding this Stipulation and Final Order and has been fully advised with regard to her rights
7 thereto, or waives any and all rights to consult with an attorney prior to entering into this
8 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below.
9 STIPULATION OF FACTS
1O 1. Ms. Ramos has been licensed by the Commission since July 17, 1989. Ms. Ramos
11 holds a Basic Teaching License issued July 2, 2004, valid through July 7, 2007, with Basic
12 Elementary and Basic Handicapped Learner endorsements.
13 2. Ms. Ramos began her employment with the Corvallis School District on August 20,
. 2001. Ms. Ramos resigned her teaching position effective June 15, 2006. During the 2005-
15 2006 school year Ms. Ramos was assigned as a teacher in the Children's Farm Home in
16 Corvallis, Oregon.
17 3. On March 10, 2006, Ms. Ramos was involved in an altercation with a physical and
18 combative special education student in her classroom at the Children's Farm Home. ln this
19 altercation, the student first bit Ms. Ramos on her arm with full force. Ms. Ramos verbally told
20 the student to stop biting, waited a few seconds, then told the student again to stop biting or she
21 would bite back. She was experiencing pain and in an effort to force the student to release his
22 bite, Ms. Ramos bit the student on his shoulder through his clothing. Ms. Ramos had bruising
23 on her arm that lasted for two weeks and a lump under her skin. She left no bite marks on the
24 student. A few minutes later, the student bit Ms. Ramos once again. As she struggled to
25 control the student he leaned out of his chair and kicked her in the face knocking her glasses ‘

-1 off. The kick caused a cut to the bridge of her nose and facial bruising. Ms. Ramos disciplined
. the student by spanking him and he stopped his struggle.
3 4. On May 23, 2006, Ms. Ramos pled guilty to Official Misconduct in the First Degree
4 ORS 162.415 to enter into a Pre-Trial Diversion Contract with the Benton County District
5 Attorney's Office. The terms and conditions of the contract include, “Defendant shall resign
6 from any and all teaching jobs, and shall not return to teaching" and that “Defendant shall
7 renounce her teaching certificate".

CONCLUSION OF LAW i
q On March 10, 2006, Heidi Louise Ramos engaged in unauthorized physical force by
18 biting back and spanking a student at the Children's Farm Home, Corvallis School District, in
19 violation of OAR 584-020-0040(4)(d). The TSPC concludes that this conduct constitutes Gross
20 Neglect of Duty. The Commission has the authority to impose discipline in this matter under
21 ORS 342.120 through 342.430 and OAR Chapter 584.
22 FINAL ORDER
23 The Commission adopts and incorporates herein the above findings of fact and
24 conclusions of law, and hereby accepts the renunciation of Ms. Ramos‘ Basic Teaching License
25 and hereby revokes said license issued ta Zeidi Lou'ze Ramos.
