1 BEFORE THE TEACHIS STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 JAMES C. JORDAN ) FINAL ORDER OF REPRIMAND 6 On September 20, 2007, the Teacher Standards and Practices Commission (Commission) 7 received a Professional Educational Experience Report Form from Oregon City School District 8 indicating that Mr. Jordan currently taught at the high school level. Mr. Jordan‘s Iicensure file 9 indicated that he had not completed the necessary educational requirements to teach at the high 1O school level. 11 Mr. Jordan fully cooperated with the Commission's investigation. After review of the matters 12 alleged, Mr. Jordan and the Commission agree that their respective interests, together with the public 13 interest, are best served by a stipulation to certain facts and a public reprimand. 14 This document sets forth the facts upon which the parties have agreed and the stipulated 15 sanction to be imposed. Mr. Jordan stipulates that there is sufficient evidence in the Commission’s 16 files and records to support the findings of fact, conclusions of law, and order set forth below. 17 By signing below, Mr. Jordan acknowledges, understands, stipulates, and agrees to the 18 following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of 19 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any 20 rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand 21 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to 22 the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon 23 and subject to approval and adoption by the Commission. lf the Commission does not approve and 24 adopt this Stipulation and Final Order, then neither Mr. Jordan nor the Commission are bound by the 25 terms herein; (iv) he has fully read this Stipulation and Final Order, and understands it completely; (v) 26 he voluntarily, without any force or duress, enters into this Stipulation and Final Order and consents to 27 issuance and entry of the Stipulated Final Order below; (vi) he states that no promises or 28 representation has been made to induce him to sign this Stipulation and Final Order; and (vii) he has Page 1 - STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - JORDAN 1 consulted with an attorney regarding this Stipulation and Final Order and has been fully advised with 2 regard to his rights thereto, or waives any and all rights to consult with an attorney prior to entering 3 into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This 4 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. Mr. 5 Jordan stipulates that there are sufficient facts contained in the Commission's files and records to 6 support the findings of fact and conclusions of law set forth below. In entering into this stipulation, Mr. 7 Jordan waives the right to a hearing to contest the findings of fact, conclusion of law and order set 8 forth below. 9 STIPULATION OF FACTS 10 1. The Commission has licensed Mr. Jordan since June 27, 1991. Mr. Jordan currently holds 11 a Basic Teaching License valid December 22, 2004, through December 22, 2007, with a Basic Social 12 Studies endorsement with elementary and middle-level grade authorizations. 13 2. Mr. Jordan taught Social Studies at the high school level in the Oregon City School District 14 without the proper Iicensure authorizations. 15 3. Although Mr. Jordan was informed by TSPC at least four times in 2004 and 2005 that his 16 license did not enable him to teach at the high school level, he accepted employment at the high 17 school level. 18 lT IS SO STIPULATED AND AGREED TO: A 19 M __/v;Z_7/p7— 20 Date 21 - ‘ 23 Victoria C m rlain, Executive Director Date 24 Teacher Standards and Practices Commission 25 CONCLUSIONS OF LAW 26 James Jordan's accepted employment for which he did not have the proper professional 27 qualifications. This conduct Constitutes Gross Neglect of Duty in violation of OAR 584-020-0040(4)(o) 28 as it incorporates OAR 584-020-0035(2)(a). The Commission has the authority to impose discipline in 29 this matter under ORS 342.120 through 342.430 and OAR Chapter 584.
