.1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS , 4 Licensure of ) AND 5 LANCE LEROY DIXON ) FINAL ORDER OF REPRIMAND 6 On or about January 6, 2006, the Teacher Standards and Practices Commission 7 (Commission) received information that Lance Leroy Dixon (Dixon), Superintendent, North 8 Powder School Service District violated standards by assigning a teacher without proper 9 Iicensure. 10 After review of the matters alleged, Mr. Dixon and the Commission agree that their 1 1 respective interests, together with the public interest, are best served by a stipulation to certain 12 facts and a public reprimand. 13 This document sets forth the facts upon which the parties have agreed and the .4 stipulated sanction to be imposed. Mr. Dixon stipulates that there is sufficient evidence in the 15 Commission’s files and records to support the findings of fact, conclusions of law, and order set 16 forth below. 17 By signing below, Mr. Dixon acknowledges, understands, stipulates, and agrees to the 18 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 19 findings of fact, conclusions of law, and order set forth below, and fully arid finally waives all 20 such rights and any rights to appeal or othenrvise challenge this Stipulation of Facts and Final 21 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 22 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and 23 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 24 Commission does not approve and adopt this Stipulation and Final Order, then neither Mr. 25 Dixon nor the Commission are bound by the terms herein; (iv) he has fully read this Stipulation .26 and Final Order, and understands it completely; (v) he voluntarily, without any force or duress, 27 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIIVIAND — DIXON .1 Final Order below; (vi) he states that no promises or representation has been made to induce 2 him to sign this Stipulation and Final Order; and (vii) he has consulted with an attorney 3 regarding this Stipulation and Final Order and has been fully advised with regard to his rights 4 thereto, or waives any and all rights to consult with an attorney prior to entering into this 5 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 6 STIPULATION OF FACTS 7 1. Mr. Dixon has been licensed by the Commission since August 16, 1995. Mr. Dixon 8 holds an Initial Administrator License issued September 24, 2003, valid through June 25, 2007, 9 with an Administrator Endorsement. Mr. Dixon also holds a Standard Teaching License issued 1O September 17, 2004, valid until June 25, 2009, with a Standard Social Studies Endorsement. 1 1 2. Mr. Dixon began employment as Superintendent for North Powder School District in 12 July of 2005. .‘3 3. During the 2004-2005 school year, Mr. Dixon's predecessor as superintendent in 14 North Powder hired and assigned Riki Anderson to serve as a special education teacher. 15 4. During the 2005-2006 school year Mr. Dixon continued the assignment of Riki 16 Anderson as a special education teacher without a Special Education Endorsement. Mr. Dixon 17 failed to access the Commission's website to verify that Ms. Anderson's assignment was 18 appr0priate for her Iicensure. Ms. Anderson served in as a special education teacher for the 19 District from September through December 1, 2005 without a Special Education Endorsement. 20 IT IS SO STIPULATED AND AGREED TO: V mg 9,,g,§;y,'g: ‘slalota 22 La eroy Dix Date 23 MM ivy-ea 24 Victoria Cha lain, Executive Director Date 25 Teacher Standards and Practices Commission U Page 2 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND — DIXON .1 CONCLUSIONS OF LAW 2 Lance Leroy Dixon assigned Riki Anderson to teach Special Education for North Powder 3 School District in violation of licensure requirements as Ms. Anderson held a Basic Teaching 4 License with a Basic Elementary Endorsement. This misconduct constitutes Gross Neglect of 5 Duty in violation of OAR 584-020-0040(4)(i) and OAR 584-050-0030(2. The Commission has 6 the authority to impose discipline in this matter under ORS 342.120 through 342.430 and OAR 7 Chapter 584. 8 ORDER 9 The Commission hereby adopts and incorporates herein the above findings of fact, 10 conclusions of law and imposes a Public Reprimand upon the licensure of Lance Leroy Dixon. 11 This order shall serve as the Public Reprimand. 12 Issued and dated this i day of August, 2006.
