1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON ' In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF SUSPENSION 5 WILLIAM ADAM DALE ) AND PROBATION 6 On June 18, 2003, the Teacher Standards and Practices Commission (Commission) 7 received a report from Mike Furrer, Executive Director of Personnel, Hillsboro School District 8 indicating that William Adam Dale (Dale) violated standards when a disabled child under his 9 supervision was seriously injured. 10 After review of the matters alleged, lvlr. Dale and the Commission agree that their 11 respective interests, together with the public interest, are best served by a stipulation to certain 12 facts, a ninety (90) day suspension of his teaching license and a two (2) year probation upon ‘ 13 reinstatement of said licensure. I 14 This Order sets forth the facts upon which the parties have agreed and the sanction to be 15 imposed. Mr. Dale stipulates that there are sufficient facts contained in the Commissions files and ' records to support the findings 0f fact and conclusion of law set forth below. In entering into this 17 stipulation, Mr. Dale waives the right to a hearing to contest the findings of fact, conclusion of law 18 and order set forth below. Mr. Dale enters into this agreement with the knowledge that the 19 Commission will suspend his teaching license for ninety (90) days. Mr. Dale understands that the 2O Commission will impose a two (2) year probation. 21 STIPULATION 0F FACTS 22 1. The Commission has licensed William Adam Dale since September 14, 1983. 23 Mr. Dale currently holds a Standard Teaching License, issued December 7, 1998, valid through 24 August 31, 2004, with Standard Physical Education, Basic Health Education and Standard 25 Handicapped Learner l Endorsements. 26 2. Mr. Dale began his employment with Hillsboro School District on August 26, 1997. 27 Mr. Dale resigned effective June 17, 2003. ' . 3. On March 7, 2002, Mr. Dale took students in his special education life skills class on a 29 field trip to a bowling alley across the Tualatin Valley Highway from Century High School. Page 1-STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION - DALE 1 Mr. Dale failed to notice a student was not on the bus to return to school. The student walked back 2 to school by himself. ' 4. On February 28, 2003, Mr. Dale failed to prevent a special education student from 4 wandering out of his classroom. This incident occurred before the morning bell rang and just after 5 an aide brought the student to the classroom‘ from the bus. The student left the classroom while 6 Mr. Dale and the classroom aides met for a few moments in Mr. Dale's office, which adjoined the 7 classroom, to discuss an issue involving the student. The meeting lasted approximately two 8 minutes. Another student informed Mr. Dale that the student left the classroom; Mr. Dale and an 9 aide immediately began looking for her. The studentjumped, or feli, from a second level rail and 10 sustained a back injury before Mr. Dale could locate her. The student had transferred from another 11 District into Mr. Dale’s classroom on February 10, 2003. During the three weeks Mr: Dale had this 12 student in his classroom prior to the accident, the student had never left the classroom without 13 permission or othen/vise wandered. 14 This Stipulation is contingent upon approval and adoption of the Order by the full . Commission. The Commissions authority to impose discipline in ‘ this matter is based upon ORS 342.175. Page 2-STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION - DALE 1 ORDER 2 William Adam Dale's Standard Teaching License is hereby suspended for a period of ninety . (90) days effective on January 10, 2004. At the end of the suspension period Mr. Dale may apply 4 for reinstatement of licensure by submitting a complete application and fees pursuant to OAR 584- 5 050-0015(3). 6 Upon reinstatement of licensure, Mr. Dale shall be placed on probation by the Commission 7 for a period of two (2) years subject to the condition that Mr. Dale comply with the Standards for 8 Competent and Ethical Performance of Oregon Educators under Oregon Administrative Rules, 9 Chapter 584, Division 020. 10 Violation of any term or condition of probation shall constitute an independent basis for the 11 Commission to revoke Mr. Dales teaching license or otherwise impose discipline, after first t 12 providing Mr. Dale with notice and opportunity for hearing on the issue of whether or not he I 13 violated probation. . 51y 14 IT IS SO ORDERED this — day of March 2004.
