1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 AUSTIN BRENT BARTON ) ORDER OF REPRIMAND 6 On or about July 14, 2005 the Teacher Standards and Practices Commission 7 (Commission) received a report from the Vale School District that Austin Brent Barton (Barton) 8 engaged in unprofessional conduct. 9 Mr. Barton fully cooperated with the Commission's investigation. After review of the 10 matters alleged, Mr. Barton and the Executive Director agree that their respective interests, 11 together with the public interest, are best served by a stipulation to certain facts and a public 12 reprimand. 13 This Order sets forth the facts upon which the parties have agreed and the sanction to 14 be imposed. Mr. Barton stipulates that there are sufficient facts contained in the Commission's 15 files and records to support the findings of fact and conclusion of law set forth below. In 16 entering into this stipulation, Mr. Barton waives the right to a hearing to contest the findings of 17 fact, conclusion of law and order set forth below. 18 This stipulation is contingent upon approval and adoption of the Order by the 19 Commission. If the Commission does not adopt this Order, neither Mr. Barton nor the 20 Commission are bound by these Stipulations, and Mr. Barton retains all rights to a hearing on 21 the allegations. 22 STIPULATION OF FACTS 23 1. Mr. Barton currently holds a Standard Administrative License with a Standard 24 Administrator endorsement, issued June 6, 2005, which expires June 5, 2010. 25 2. On July 14, 2005, the Commission received a report from the Superintendent of the 26 Vale School District indicating that Mr. Barton was involved in a relationship with a subordinate 27 during school time. Page 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND —BARTON 1 3. Mr. Barton admitted to engaging in sexual relations with his subordinate during his 2 assigned work hours. Mr. Barton resigned from the Vale School District in June of 2005. 3 4. This misconduct 14 constitutes Gross Neglect of Duty in violation OAR 584-020-0040(4)(b). The Commission's 15 authority to impose discipline in this matter is based upon ORS 342.175. 1 6 ORDER 17 ' The Commission hereby adopts the above findings of fact and imposes a Public 18 Reprimand upon the Licensure of Austin Brent Barton.
