1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) 4 Teaching License of ) STIPULATION OF FACTS, 5 JOSEPH HIRAM ELMORE ) SURRENDER, AND 6 ) ORDER OF REVOCATION 7 On or about March 20, 2001, the Teacher Standards and Practices Commission 8 (Commission) received a newspaper article published in The Oregonian indicating that 9 Joseph Hiram Elmore (Elmore), an industrial mechanic instructor, was under 1O investigation in connection with the misappropriation of car parts donated to the school 11 shop at Sprague High School, Salem-Keizer Public Schools. 12 After review of the matters alleged, Mr. Elmore and the Commission agree that 13 their respective interests, together with the public interest, are best served by a I stipulation to certain facts and surrender of his teaching license pursuant to OAR 584- 15 050-0027. 16 This Order sets forth the facts upon which the parties have agreed and the 17 sanction to be imposed. In entering into this stipulation, Mr. Elmore waives the right to a 18 hearing to contest the findings of fact, conclusions of law and order set forth below. Mr. 19 Elmore understands that the Commission will revoke his teaching license. 20 This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. If the Commission does not adopt this Order, neither Mr. Elmore nor the 22 Commission are bound by these Stipulations and Mr. Elmore retains all rights to a 23 hearing on the allegations. 24 /// i3 //l ' Page 1 STIPULATION OF FACTS, SURRENDER, AND ORDER 0F REVOCATION - ELMORE .1 STIPULATION OF FACTS 2 1. Mr. Elmore has been licensed by the Commission since July 24, 1981. Mr. 3 Elmore’s current StandardTeaching License was issued on March 10, 1998, valid until 4 March 6, 2003, with Standard Technology Education and Mechanical Technology 5 Endorsements. 6 2. Mr. Elmore was employed by Salem-Keizer Public Schools beginning in 1981. 7 Mr. Elmore resigned his position as shop teacher at Sprague High School on June 29, 8 2001. 9 3. Mr. Elmore failed to document and receipt monies generated by donations, 10 sales of vehicles and equipment in connection with his duties as industrial mechanics 11 teacher at Sprague High School. 2 4. On or about May 23, 2002, Mr. Elmore pled “no contest" and was convicted of Q3 Theft I (felony) in Marion County Circuit Court, Case #02044816. The Court placed 14 Mr. Elmore on probation for 24 months, ordered him to forfeit his teaching license and 15 ordered that he must not assume any treasurer type positions or positions dealing with 16 money.
