1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Licensure of ) AND 5 NATALIE ANN COOP ) FINAL ORDER OF REPRIMAND 6 On December 7, 2006, the Teacher Standards and Practices Commission (Commission) 7 received a report from Dan Alexander, Superintendent, Prospect School District alleging that 8 during the 2006-2007 school year, Natalie Ann Coop (Coop), sold carbonated sugared sodas 9 from her classroom in violation of the Districts Wellness Policy. 10 After review of the matters aiieged, fv'is. Coop and the Commission agree that their 11 respective interests, together with the public interest, are best served by a stipulation to certain 12 facts and a public reprimand. 13 This document sets forth the facts upon which the parties have agreed and the 14 stipulated sanction to be imposed. Ms. Coop stipulates that there is sufficient evidence in the 15 Commission's files and records to support the findings of fact, conclusions of law, and order set 16 forth below. 17 By signing below, Ms. Coop acknowledges, understands, stipulates, and agrees to the 18 following: (i) she has been fully advised of his rights to notice and a hearing to contest the 19 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 20 such rights and any rights to appeal or othen/vise challenge this Stipulation of Facts and Final 21 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 22 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and 23 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 24 Commission does not approve and adopt this Stipulation and Final Order, then neither Ms. 25 Coop nor the Commission are bound by the terms herein; (iv) she has fully read this Stipulation 26 and Final Order, and understands it completely; (v) she voluntarily, without any force or duress, 27 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated 28 Final Order below; (vi) she states that no promises or representation has been made to induce Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND — COOP 1 him to sign this Stipulation and Final Order; and (vii) she has consulted with an attorney 2 regarding this Stipulation and Final Order and has been fully advised with regard to her rights 3 thereto, or waives any and all rights to consult with an attorney prior to entering into this 4 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 5 STIPULATION OF FACTS 6 1. Ms. Coop has been licensed by the Commission since January 11, 1991. Ms. Coop 7 most recently held a Standard Teaching License issued August 6, 2004. Said license expires 8 July 7, 2009. 9 2. During the fall of 2006-2007 school year IvIs. Coop sold food items including 10 carbonated sugared soda from her classroom. On a previous occasion the school’s Principal 11 instructed Ms. Coop not to sell food items from her classroom as they violated the District's 12 Wellness Program and competed with the lunch program. The Principal permitted Ms. Coop to 13 finish providing the food to students until the items she had purchased were all sold. 14 3. In November 2006 the Principal went to Ms. Coop's classroom to investigate whether 15 she was selling soda after concerns were raised about this practice by a School Board member. 16 The Principal found soda for sale and the names of students owing money for purchased sodas 17 on the board. If asked to testify, she would state that she did not understand the directive to 18 stop providing food to include drinks as well. 19 4. Ms. Coop provided soda to students on an honor system in which they were 20 supposed to reimburse the teacher for the drinks and food. Ms. Coop states that she lost 21 money overall because students did not always pay her for the drinks they took. Coop Date 4 ' [kW-0; 5 ictoria ' , Executive Director Date 6 Teacher Standards and Practices Commission 7 CONCLUSIONS 0F LAW 8 During the 2006-2007 school year at Prospect School District, Natalie Ann Coop violated 9 OAR 584-020-0010(5) when she failed to use professional judgment by selling food in violation 10 of district policy. Ms. Coop failed to uphold the duties of the Ethical Educator, OAR 584-020- 11 0035(2)(e), when she used district and school property and resources for noneducational 12 benefit without the approval of her supervisor. This misconduct constitutes Gross Neglect of 13 Duty, pursuant to OAR 584-020-0040(4)(n) as it incorporates OAR 584-020—0035(2).
