l 2 their respective interests‘ together with the public interest, are best served by a
13 stipulation to certain facts and the imposition of a pnhlit: reprimand and a four year
l4 probation period.

16 to the following: (i) he has been fully advised of his rights to notice. and a hearing to
17 contest the ﬁndings of fact, conelimions of law, and order set forth below, and fully and
18 ﬁnnlly waives all such rights and any rights to appeal or otherwise challenge this
19 Stipulation of Facts and Final Order of Reprimand and Probation (Stipulation and Final
20 Order): (ii) this Stipulation and Final Order is a public document and disclosed to the
21 public upon request'by the Commission; (iii) this Stipulation and Final Order is
22 contingent upon and subject to approval and adoption by the Commission. lf the
23 Commission does not approve and adopt this Stipulation and Final Order, then neither
24 Williamson nor the Commission are bound by the terms herein; (iv) he has fully read
25 this Stipulation and Final Order. and understands it completely; (vi he voluntarily

1 (020), was issued on August 21. 2011, and expires on August 20, 2016. During all
2 relevani times, Williamson was employed by the North Clackamas School District,
3 2. On November 15, 2011, the Commission received a report that Williamson had exercised
4 poor judgment in student management. An investigation was conducted by both the
5 district and the Commission. Investigations determined that while substituting at
6 Milwaukie High School, Williamson and a student (JF) engaged in a eonﬁ'ontation in
7 from of the classroom. JF was disruptive, vulgar, profane and disrespectful,
8 V\’illiamson’s responses included verbally embarrassing JF in front of other students,
9 tolling the classroom that “JFdirlnY get enough nttemionfrom his mommy and daddy”,
10 and physically grabbing JFR hood and backpack and redirecting him closer to face

12 JF, At one point, Williamson said in response to JF “Obviously you don’t want this to
13 end, so I ‘l! tell you wlmt. I ’m going to trike off my glasses,.... put my hands behind my
14 hack, mid ifyon desire you can rake three/‘rec shuts at me. but‘ uﬂer {hot I think the law
15 would say that! have o right to defend myself“

l 26 Daniel E, Williamson verbally demeaned a student in front of other students and
27 placed his hand on the smdentk hoody sweatshirt. During the conﬂict, Williamson
28 attempted to resolve the situation but the student remained antagonistic. Williamson
29 erred when he made the comment to the student, “Obviously you don’! wont this lo end,
30 so I ’Il tell you what, I ’m going to lake offing; glossesw. put my hands behind my back,

32 would say that I have a right to defend myself" This conduct constitutes gross neglect
33 of duty in violation of ORS 342.175 (1)(b); OAR 584-020-0040(4)(n) as it incorrmrates

l 8 Based on the foregoing, the (‘om mission hereby orders as follows:
i 9 L The Commission adopts and incorporates herein the above ﬁndings of fact‘ and
‘ 10 conclusions of law, and based thereon imposes a Public Roprimand on
‘ 11 Daniel E. Williamson’s Educator License; I
12 2. Williamson is hereby placed on probation for a period of one (1) year from the
13 date this order is signed by the Commission subject to the following conditions:
14 a. Williamson shall comply with the Standards for Competent and Ethical
15 Performance of Oregon Educators under Oregon Administrative Rules
16 Chapter 584, Division 020' ~
17 Violation ofany term or condition of probation shall constitute an independent
18 basis for the Commission to revoke Williamson's teaching, license or othmwise impose
19 discipline, after ﬁrst providing Williamson with notice and opportunity for hearing,
