1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ' OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND g Cory Eugene Snively ) ORDER OF REPRIMAND 7 On or about September 7, 2004, the Teacher Standards and Practices Commission 8 (Commission) received a report from Kathryn Baker, Superintendent of Salem-Keizer Public 9 Schools, indicating that Cory Eugene Snively allowed softball team members to use a non- 10 certified bat during regular games in the 2003-2004 softball season. 11 Mr. Snively fully cooperated with the Commission's investigation. After review of the 12 matters alleged, Mr. Snively and the Executive Director agree that their respective interests, 18 together with the public interests, are best served by a stipulation to certain facts and a 1' reprimand. 15 This Order sets forth the facts upon which the parties have agreed and to the sanction 16 to be imposed. Mr. Snively stipulates that there are sufficient facts contained in the 17 Commission’s files and records to support the findings of fact and conclusions of law set forth i 18 below. In entering into this stipulation, Mr. Snively waives the right to a hearing to contest the 1 19 findings of tact, conclusion of law and order set forth below. ‘ 2O The stipulation is contingent upon approval and adoption of the Order by the 21 Commission. lithe Commission does not adopt this Order, neither Mr. Snively nor the 22 Commission are bound by these stipulations and Mr. Snively retains all rights to a hearing on 23 the allegations. 24 STIPULATION 0F FACTS b 1. The Commission has licensed Cory Eugene Snively since April 3, 1986. 26 Mr. Snively currently holds a Standard Teaching License valid July 21, 2000, through 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND — CORY EUGENE SNIVELY 1 August 27, 2005, with endorsements in Basic Integrated Math and Standard Advanced . Mathematics. 3 2. Mr. Snively began his employment as a Math teacher at North Salem High School, 4 Salem-Keizer Public Schools on August 28, 2001. Mr. Snively coached girl’s softball during 5 the 2004 season. 6 3. During the 2004 softball season Mr. Snively allowed his daughter, playing on the 7 softball team, to use a non-certified bat during games. Mr. Snively instructed his daughter to 8 keep the bat in her bag until she needed it. 9 4. Members of the softball team were aware that Mr. Snively allowed his daughter to 1O use a non-certified bat and that Mr. Snively instructed his daughter to keep the bat hidden. 11 5. Mr. Snively acknowledges that his behavior, described above, was inappropriate 12 and accepts responsibility for his conduct. . CONCLUSION 0F LAW 14 During the 2004 softball season Mr. Snively knowingly he allowed his daughter, a i 15 member of the softball team, to use a non-certified bat during the games. Players and 16 parents of team members became aware that Mr. Snively instructed his daughter to keep the 17 bat hidden when she wasn't using it. This behavior violates OAR 584-020-0035(3)(a) and 18 constitutes Gross Neglect of Duty pursuant to OAR 584-020-0040(4)(o).
