OF THE STATE OF OREGON ' 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF 6 ROSE MARY MANN ) LICENSE REVOCATION 7 8 On October 14, 2003, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportuniw for Hearing to Rose Mary Mann (Mann) in which the Commission 10 charged her with misconduct under ORS 342175. The Notice was sent via U.S. First Class 11 Mail and U.S. Certified Mail Receipt 7002 2410 0001 9754 7269 to the address obtained by the 12 Commission and verified as her residence. On October 23, 2003, the U.S. Certified Mail and 13 First Class Mail envelopes were returned to the Commission marked “Return to sender moved 14 left no address unable to forward." The Notice of Opportunity of Hearing, dated October 14, 15 2003, and signed by Victoria Chamberlain, Executive Director, stated: _ 0 "You, Rose Mary Mann, are entitled to a hearing on the proposed action of the ‘ Commission. If you want a hearing, you must file a written request for a hearing 8 with the Commission within 21 days of the date of this notice. Attached to this 19 notice is a copy of the procedures, right of representation and other rights of 20 parties relating to the conduct ofa hearing as required under ORS 183.413(2)." 21 22 Ms. Mann did not request a hearing. The Commission, therefore, finds 23 Ms. Mann to be in default and enters the following findings of fact, conclusions of law 24 and order, based on the files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. Ms. Mann holds a Standard Teaching License with endorsements in Basic 27 Elementary and Standard Handicapped Learner I, issued June 16, 1999, valid until June 29, 28 2004. 29 2. Ms. Mann was employed by Chemawa Indian School as a substitute teacher ‘ 30 beginning March 20, 1995. I PAGE 1 — DEFAULT ORDER OF LICENSE REVOCATION - MANN '1 3. On January 2, 2003, the Commission received a report from Larry Byers, 2 Superintendent, Chemawa Indian School alleging that Ms. Mann was not mentally capable of 3 performing her duties as a teacher. 4 4. Ms. Mann failed to respond to requests for information, furnish documents or 5 participate in an interview with a Commission representative relating to a Commission 6 investigation. 7 CONCLUSIONS OF LAW ‘ . 8 The above conduct constitutes Gross Neglect of Duty in violation of OAR 584-020- 9 0040(4)(p).
