I BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION .2 OF THE STATE OF OREGON ' 3 4 In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) LICENSE REVOCATION AND 6 KARL DEAN PRIEST ) REVOCATION OF RIGHT TO 7 ) APPLY FOR A LICENSE 8 On January 4, 2005, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Karl Dean Priest (Priest) in which the Commission 10 charged him with conviction of crimes listed in ORS 342.143(3). The Notice was sent via U.S. II First Class Mail and U.S. Certified Mail Receipt #7003 2260 0000 8922 9170 to the address 12 Mr. Priest provided to the Commission. The certified mail receipt was signed by Mr. Priest and 13 returned to the Commission on January 6, 2005. The Notice of Opportunity of Hearing, dated 14 January 4, 2005, and signed by Victoria Chamberlain, Executive Director, stated: 15 "You, Karl Dean Priest, are entitled to a hearing on the proposed action of the 16 Commission. It you want a hearing, you must file a written request for a hearing with the Commission within 21 days of the date of this notice. Attached to this ‘ notice is a copy of the procedures, right of representation and other rights of l9 parties relating to the conduct of a hearing as required under ORS 183.413(2).” 20 21 Mr. Priest did not request a hearing. The Commission, therefore, finds 22 Mr. Priest to be in default and enters the following findings of fact, conclusions of law 23 and order, based on the tiles and records ot the Commission concerning this matter. 24 FINDINGS OF FACT 25 1. Mr. Priest currently holds a Basic Teaching License issued February 28, 2002, valid 26 until March 29, 2005, with Basic Drama and Basic Language Arts Endorsements. 27 2. Mr. Priest was employed by The Dalles School District from September of 1983 until 28 April 22, 2004, when he resigned his employment with the District. 29 3. On or about November 29, 2004, Karl Dean Priest was convicted of two counts of 30 Encouraging Child Sex Abuse ll, ORS 163.686, in the Circuit Court ot the State of Oregon tor ‘ the County of Wasco. On or about November 29, 2004, Karl Dean Priest was convicted of two counts of 2 Official Misconduct I, ORS 162.415, in the Circuit Court of the State of Oregon for the County of 3 Wasco. 4 CONCLUSIONS OF LAW 5 Mr. Priest's convictions for Encouraging Child Sex Abuse ll, as defined in ORS 163.686 6 are listed in ORS 342.1436). The Commission is required to revoke the Oregon Basic 7 Teaching License issued to Kari Dean Priest and revoke his right to apply for a license pursuant 8 t0 ORS 342.175(2). 9 Mr. Priest's convictions for Official Misconduct I, ORS 162.415 constitute Gross 10 Unfitness in violation of OAR 584-020-0040(5)(c). The Commission's authority to impose II discipline in this matter is based upon ORS 342.175.
