1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘ OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 KATHRYN ANNE GRANT ) AND PROBATION 6 On June 6, 2005, the Commission received a report from Superintendent Johnson indicating that 7 Ms. Grant corrected and modified student rough drafts of the state writing assessment in violation of 8 testing protocol for the Oregon Statewide Writing Assessment. 9 Ms. Grant fully cooperated with the Commission's investigation. After review of the matters 1O alleged, Ms. Grant and the Commission agree that their respective interests, together with the public 11 interest, are best sewed by a stipulation to certain facts, the imposition of a public reprimand followed by 12 a three (3) year probation. 13 This document sets forth the facts upon which the parties have agreed and the stipulated 14 sanction to be imposed. Ms. Grant stipulates that there is sufficient evidence in the Commission's files 15 and records to support the findings of fact, conclusions of law, and order set forth below. ‘6 By signing below, Ms. Grant acknowledges, understands, stipulates, and agrees to the following: (i) she has been fully advised of her rights to notice and a hearing to contest the findings of fact, 18 conclusions of law, and order set forth below, and fully and finally waives all such rights and any rights to 19 appeal or othen/vise challenge this Stipulation of Facts, Final Order of Reprimand and Probation 20 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to 21 the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon and 22 subject to approval and adoption by the Commission. If the Commission does not approve and adopt this 23 Stipulation and Final Order, then neither Ms. Grant nor the Commission are bound by the terms herein; 24 (iv) she has fully read this Stipulation and Final Order, and understands it completely; (v) she voluntarily, 25 without any force or duress, enters into this Stipulation and Final Order and consents to issuance and 26 entry of the Stipulated Final Order below; (vi) She states that no promises or representation has been 27 made to induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an attorney 28 regarding this Stipulation and Final Order and has been fully advised with regard to her rights thereto, or 29 waives any and all rights to consult with an attorney prior to entering into this Stipulation and Final Order ‘J and issuance and entry of the Stipulated Final Order below. Ms. Grant stipulates that there are sufficient .2 facts contained in the Commission's files and records to support the findings of fact and conclusions of 3 law set forth below. In entering into this stipulation, Ms. Grant waives the right to a hearing to contest the 4 findings of fact, conclusion of law and order set forth below. Ms. Grant understands that the probation will 5 be subject to specific terms and conditions. 6 STIPULATION 0F FACTS 7 1. Ms. Grant has been licensed by the Commission since January 7, 1977. Ms. Grant currently 8 holds a Basic Teaching License valid January 6, 2006, through January 5, 2009, with Basic Educational 9 Media and Basic Elementary endorsements. 1O 2. Ms. Grant began teaching for Jefferson County School District on August 29, 2000. 1 1 3. While proctoring the 2004-2005 Oregon Statewide Writing Assessment Ms. Grant corrected 12 and modified student rough drafts in violation of testing protocol. Multiple students reported that Ms. 13 Grant “corrected their papers,“ then returned them with corrections for them to copy onto their final drafts. 14 4. Ms. Grant admitted her mistake and stated that she was acting under the erroneous belief that i the test was a practice test. Ms. Grant enters into this Stipulation of Facts with the knowledge that the Commission shall place 17 her on probation for a period of three (3) years. This Stipulation is contingent upon approval and adoption 18 of the Order by the full Commission. If the Commission does not adopt this Order, neither Ms. Grant nor 19 the Commission are bound by these stipulations and Ms. Grant retains the right to a hearing on the 20 allegations. 21 IT S USTIPULATED AND AGREED TO: 22 \ aliksfi . This conduct constitutes Gross Neglect of Duty. The Page 2 - STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND AND PROBATION - GRANT 1 Commission's authority to impose discipline in this matter under ORS 342.120 through 342.430 and OAR .2 Chapter 584. 3 FINAL ORDER ' 4 The Commission adopts and incorporates herein the above finding of facts, conclusions of law, 5 and based thereon, hereby imposes a Public Reprimand on Kathryn Anne Grant. This Order shall serve 6 as the Public Reprimand. 7 Furthermore, the Commission places Ms. Grant on Probation for a period of three (3) years to 8 commence the date of this order, subject to the following terms and conditions of probation: 9 1.
