1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ' OF THE STATE OF OREGON 3 In the Matter ofthe ) STIPULATION OF FACTS, 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 LAWRENCE ROY CRAIN ) AND PROBATION 6 On or about October 24, 2005, the Teacher Standards and Practices Commission 7 (Commission) received a report from Randal Gravon, Superintendent, Central Point School District 8 indicating that Lawrence Roy Crain (Crain) failed to maintain an appropriate student teacher 3 9 relationship On January 6, 2006 the Commission received a second report from the District , 1O regarding inappropriate Internet use. 11 Mr. Crain fully cooperated with the Commission's investigation. After review of the matters 12 alleged, Mr, Crain and the Commission agree that their respective interests, togetherwith the public 13 interest, are best served by a stipulation to certain facts, the imposition ofa Public Reprimand and a 14 two (2) year probation. . This document sets forth the facts upon which the parties have agreed and the stipulated 16 sanction to be imposed. Mr. Crain stipulates that there is sufficient evidence in the Commission's files 17 and records to support the findings of fact, conclusions of law, and order set forth below. 18 By signing below, Mr. Crain acknowledges, understands, stipulates, and agrees to the 19 following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of 20 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any 21 rights to appeal or othenlvise challenge this Stipulation of Facts, Final Order of Reprimand and 22 Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and 23 disclosed to the public upon request by the Commission; (iii) this Stipulation and Final Order is 24 contingent upon and subject to approval and adoption by the Commission. Ifthe Commission does 25 not approve and adopt this Stipulation and Final Order, then neither Mr. Crain nor the Commission are 26 bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and understands it ' completely; (v) he voluntarily, without any force or duress, enters into this Stipulation and Final Order Page 1 STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND AND PROBATION - Crain 1 and consents to issuance and entry of the Stipulated Final Order below; (vi) he states that no . promises or representation has been made to induce him to sign this Stipulation and Final Oder; and 3 (vii) he has consulted with an attomey regarding this Stipulation and Final Order and has been fully 4 advised with regard to his rights thereto, or waives any and all rights to consult with an attomey prior 5 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order 6 below. 7 STIPULATION OF FACTS 8 1 The Commission has licensed Lawrence Roy (‘rain since April 12, 1973. Mr. Crain 9 I currently holds a Standard Teaching License valid October 28, 2004, through October 17, 2009, with 1O Basic Mathematics, Basic Spanish and Standard Language Arts Endorsements. 11 2. During Mr. Crain’s 33 year history as a licensed educator in Oregon, prior to the events 12 giving rise to this order, the Commission has not received a complaint ora report regarding Mr. Crain. 13 3. Mr. Crain is employed by the Central Point School District as a Spanish teacher at Crater . High School. Mr. Crain has served as a teacher at Crater High School since 1985. 15 4. Mr. Crain failed to properly supervise the activities of students using his classroom 16 computer. 17 5. Mr. Crain transported a student in his personal vehicle to the coast in Brookings, Oregon in 18 June of 2005. This was not a school or educational related trip. 19 6. This misconduct constitutes Gross Neglect of Duty. The 5 Commission has authority to impose discipline in this matterunder ORS 342.120 through 342.430 6 and OAR Chapter 584. 7 ORDER 8 The Commission hereby adopts and incorporates nerein the above findings of fact and 9 imposes a Public Reprimand on Lawrence Roy Crain. This Stipulation of Facts, Order and Probation 1O constitute the Reprimand. 11 Furthermore, the Commission imposes a two (2) year probation upon Mr. Crain requiring that 12 Mr. Crain comply with all Standards for Competent and Ethical Performance under Oregon 13 Administrative Rules, Chapter 584, Division 020. .
