HAROUFF ) REVOCATION OF RIGHT TO 7 ) APPLY FOR A LICENSE 8 9 On March 29, 2006, the Teacher Standards and Practices Commission (Commission) 10 issued a Notice of Opportunity for Hearing to Noah J. Harouff (Harouff) in which the 11 Commission charged him with conviction of crimes listed in ORS 342.143(3). The Notice was 12 sent via U.S. First Class Mail and U.S. Certified Mail Receipt #7005 0390 0005 5794 9160 to 13 the address obtained by the Commission. The U.S. Certified Mailing receipt was signed by 14 Tami Harouff and returned to the Commission on March 31, 2006. The Notice of Opportunity of 15 Hearing, dated March 29, 2006, and signed by Victoria Chamberlain, Executive Director, stated: 16 "You, Noah J. Harouff, are entitled to a hearing on the proposed action of the 17 Commission. If you want a hearing, you must tile a written request for a hearing 18 with the Commission within 21 days of the date of this notice. Attached to this Q notice is a copy of the procedures, right of representation and other rights of .- parties relating to the conduct of a hearing as required under ORS 183.413(2)." 21 22 Mr. Harouff did not request a hearing. The Commission, therefore, finds 23 Mr. Harouff to be in default and enters the following findings of fact, conclusions of law 24 and order, based on the files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. Mr. Harouff was originally licensed by the Commission on August 27, 1998. 27 Mr. Harouff currently holds a Standard Teaching License issued April 16, 2002, valid until 28 April 12, 2007, with Endorsements in Basic ESOL and Standard Spanish. 29 2. Mr. Harouff began employment with Salem-Keizer School District as a licensed 30 teacher on August 31, 1999. On January 9, 2006, Mr. Harouff was placed on administrative 31 leave. 1 - DEFAULT ORDER OF LICENSE REVOCATION AND REVOCATION OF RIGHT TO APPLY - HAROUFF 1 3. On February 24, 2006, Noah J. Harouff was convicted of three counts of Attempted . Sexual Abuse 1, ORS 163.427, in the Circuit Court of the State of Oregon for the County of 3 Polk. 4 CONCLUSIONS OF LAW 5 Noah J. Harouff’s conviction of three counts of Attempted Sexual Abuse 1, as defined by e ORS 163.427 is listed in ORS 342.143(3). The Commission is required to revoke the Standard 7 Teaching License issued to Mr. Harouff and revoke his right to apply for a license pursuant to 8 ORS 342.175(2). The Commission’s authority to impose discipline in this matter is based upon 9 ORS 342.175. 10 ORDER 11 The Commission hereby revokes the Standard Teaching License issued to Noah J. 12 Harouff and revokes his right to apply for a teaching license. 13 IT IS so ORDERED this A!’ day of May, 2006.
