OF THE STATE OF OREGON 3 4 In the Matter of the | 5 Teaching License of l DEFAULT ORDER , 6 JACK MORRIS WALKER I SUSPENDING LICENSE 7 l 8 9 10 On or about August 30, 2002, the Teacher Standards and Practices Commission received a report 11 from Ed Schumacher, Superintendent of Union-Baker Education Service District, indicating that 12 Jack Walker violated his contract by failing to provide 60 days’ written notice prior to 13 resignation. The district did not include the documents required under OAR 584-050-0020. 14 Subsequently, the District submitted the requested documents on November 18, 2002. The 15 Commission notified Jack Walker of intent to suspend his teaching license and his opportunity 16 for hearing by letter dated November 22, 2002. The letter was sent by U.S. First Class Mail and 17 U.S. Certified Mail—Retum Receipt Requested #7001 0320 0005 0740 5413. The receipt was 18 signed by Sandra Walker on November 26, 2002, and returned to TSPC on November 27, 2002. 19 Jack Walker did not request a hearing. 20 21 Jack Walker did not request a hearing within the time required by the notice. Based on the 22 foregoing, the Commission finds Jack Walker to be in default and enters the following findings 23 of fact, conclusion of law and order based on the Commission’s files and records. > 25 26 FINDINGS OF FACT . 27 28 l. On or about October 25, 2001, Jack Walker signed a Licensed Probationary Teacher’s 29 Contract with Union Baker ESD. On March 8, 2002, Jack Walker was offered a position 30 as Alternative Education Teacher at the Grant Alternative School in John Day. 3 1 32 2. On or about August 24, 2002, Jack Walker informed the Union Baker Education Service 33 District via a faxed letter that he was resigning his position effective immediately. The 34 District was not able to contact Jack Walker upon receiving his resignation. The District 35 anticipated serving students on August 26, 2002. 36 37 3. On or about August 30, 2002, TSPC received a report from Ed Schumacher, 38 Superintendent of Union Baker Education Service District, indicating that Jack Walker 39 violated terms of his contract for failure to provide sixty days notice prior to resignation. 40 On September 4, 2002, TSPC requested additional documentation from the District as 41 outlined in OAR 584-050-0020. 42 43 4. Meeting in regular session on November 7, 2002, the Union-Baker ESD Board of 44 Education adopted a resolution requesting suspension of the teaching license of Mr. Jack 45 Walker in accordance with ORS 342.553.
