1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF _ 6 GARY STEPHEN WIESE ) DENIAL OF LICENSURE 7 ) 8 0n or about June 25, 2002, the Teacher Standards and Practices Commission 9 (Commission) received a Application for Educator License Form C-1 from Gary Stephen Wiese 10 (Wiese) requesting renewal of a Standard Teaching License. Mr. Wiese responded “no” to 11 Character Question 7, “Have you ever been disciplined by any public agency responsible for 12 licensure of any kind, including but not limited to educational licensure?" Mr. Wiese's response 13 constituted a false statement directly related to licensure. The Commission adopted a 14 Stipulation of Facts, Public Reprimand and Order disciplining Mr. Wiese on January 19, 2000. 15 The Executive Director took action to notify Mr. Wiese of intent to deny his license, and to inform 16 him of his opportunity for hearing. The notice was sent via U.S. First Class Mail and U.S. l7 Certified Mail Receipt 7001 0320 0005 0740 8681. The certified mail receipt was signed and 18 dated on July 30, 2002. l9 The Notice of Opportunity of Hearing, dated July 25, 2002, and signed by Victoria 20 Chamberlain, Executive Director, stated: 21 "You, Gary Stephen Wiese, are entitled to a hearing on the Commission's denial 22 of your license. In denying your license the Commission has followed and will 23 follow the procedures set out in ORS 342.176 and 342.177, in conformance with 24 ORS 342.143(4). If you want a hearing, you must file a written request for a 25 hearing with the Commission within 21 days of the date of this notice. Attached 26 to this notice is a copy of the procedures, right of representation and other rights 27 of parties relating to the conduct of a hearing as required under ORS 28 183.413(2)." 29 30 Mr. Wiese did not request a hearing. The Commission, therefore, finds 31 Mr. Wiese in default and enters the following findings of facts, conclusion of law and 32 order based on the files and records of the Commission. On or about June 25, 2002, Gary Stephen Wiese signed and submitted an 3 Application for Educator License Form C-1 requesting renewal of his Standard Teaching 4 License. 5 2. On or about June 25, 2002, Gary Stephen Wiese responded "no" to Character 6 Question 7, “Have you ever been disciplined by any public agency responsible for licensure of 7 any kind, including but not limited to educational licensure?" 8 3. Gary Stephen Wiese’s response to character question 7 constitutes a false statement 9 directly related to Licensure. The Commission adopted a Stipulation of Facts, Public Reprimand 10 and Order in the matter of the Teaching License of Gary Stephen Wiese on January 19, 2000. 11 CONCLUSIONS OF LAW 12 Gary Stephen Wiese made a false statement on his application for renewal of his ‘ teaching license.
