OF THE STATE OF OREGON 3 In the Matter ot the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF REPRlMAND 5 REWI JAMES WARD ) AND PROBATION 6 On or about May 11, 2004, the Teacher Standards and Practices Commission 7 (Commission) received a complaint from Maureen Sloane, Human Resources Counsel for the 8 Portland Public Schools. The complaint alleged Rawi Ward appeared at a school function 9 under the influence of alcohol. Mr. Ward fully cooperated with the Commission's investigation. 1O After review of the matters alleged, Mr. Ward and the Commission agree that their 11 respective interests, together with the public interest, are best served by a stipulation to certain 12 facts, the imposition of a Public Reprimand ancl a four (4) year probation. This Order sets forth 13 the facts upon which the parties have agreed and the sanction to be imposed. Mr. Ward 14 stipulates that there are sufficient facts contained in the Commission's files and records to ‘ support the findings of fact and conclusions of law set forth below. In entering into this 16 stipulation, Mr. Ward waives the right to a hearing to contest the findings of fact, conclusions of 17 law and order set forth below. Mr. Ward understands that the probation will be subject to 18 specific conditions. 19 Rewl James Ward enters into this Stipulation of Facts with the knowledge that the 2O Teacher Standards and Practices Commission shall place him on probation for a period of four 21 (4) years. This Stipulation is contingent upon approval and adoption of the Order by the full 22 Commission. lf the Commission does not adopt this Order, neither Mr. Ward nor the 23 Commission are bound by these stipulations and Mr. Ward retains the right to a hearing on the 24 allegations. On June 1, 2003, the Commission issued Mr. Ward a Standard Teaching License, 3 with Basic Biology, Basic Integrated Science and Basic Spanish endorsements. Said license is 4 valid until December 7, 2008. 5 2. Mr. Ward is employed by Portland Public Schools. He began his employment with 6 the District in September of 1999. 7 3. On Sunday May 2, 2004, Mr. Ward arrived at George Middle School to accompany a 8 group 0f students to the Outdoor School under the influence of alcohol. 9 4. On May 6, 2004, Mr. Ward entered Serenity Lane residential treatment program and 10 successfully completed the residential treatment on May 28, 2004. 11 5. This misconduct constitutes Gross 22 Neglect of Duty. The Commission’s authority to impose discipline in this matter is based upon 23 ORS 342.175. 24 /// , 25 /// 26 // / O Page 2 STIPULATION OF FACTS, ORDER OF REPRlMAND AND PROBATION - 1 ORDER . The Commission adopts the above stipulation of facts and imposes a Public Reprimand 3 upon Mr. Ward. This Stipulation of Facts, Order and Probation constitute the Reprimand. 4 Furthermore, the Commission imposes four (4) year probation upon Mr. Ward effective 5 November 3, 2005, subject to the following terms and conditions: 6 1. Mr. Ward shall abstain from the consumption of alcohol; 7 2. During the period of this probation, Mr. Ward shall report in writing within ten days to 8 the Executive Director of the Commission any arrest or citation for any felony, misdemeanor, 9 major traffic violation or violation of criminal probation; 10 3. During the period of his probation, Mr. Ward shall comply with all Standards for 11 Competent and Ethical Performance of an educator under Oregon Administrative Rules Chapter 12 584, Division O20; and 13 4. Mr. Ward shall provide reports every six (6) months during his probation, on or . before: February 5, 2006; August 5, 2006; February 5, 2007; August 5, 2007; 15 February 5, 2008; August 5, 2008; February 5, 2009; and August 5, 2009. 16 If Mr. Ward does not comply with all terms and conditions of this probation, as 17 determined by the Executive Director, he shall be in violation of this probation.
