1 l BEFORE THE TEACHERS AND STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON . 3 4 In the Matter of the ) STIPULATION OF FACTS 5 Teaching License of ) ORDER OF SUSPENSION 6 DOUGLAS SCOTT WAGERS ) AND PROBATION 7 ) 8 9 On November 23, 1998, the Teacher Standards and Practices Commission informed 10 Douglas Scott Wagers that the Commission found sufficient evidence of violation of ll Standards for Competent and Ethical Performance of Oregon Educators to warrant a 12 hearing regarding charges against him. Mr. Wagers requested a hearing on the l3 allegations, but before a hearing date was set, the parties have agreed that their 14 respective interest and the interests of the State are best served by a Stipulation of 15 Facts and Order of Suspension and Probation as set forth below. ‘ C l7 STIPULATION OF FACTS l 8 l9 l. Douglas Scott Wagers holds a Standard Teaching License endorsed for music 20 and valid from December 20, 1996 to November 28, 2001. 2 1 22 2. During the month of April 1998 Wagers used School District equpment to access 23 the Internet for personal, non-educational purposes. 24 25 3. During the month of April 1998 Wagers used School District equipment to 26 access Internet sites that displayed sexually explicit images. 27 i 28 4. On May 14, 1998, Wagers signed a Settlement Agreement with the McMinnville . 29 School District and submitted his resignation in lieu of dismissal. 30 3 1 32 Douglas Scott Wagers enters into this Stipulation of Facts with knowledge that the 33 Teacher Standards and Practices Commission will suspend his license for 30 days, 34 require an evaluation by a mutually acceptable medical professional to verify fitness 3S prior to reinstatement, and place him on probation for two years following 36 reinstatement. This Stipulation is contingent upon approval and adoption of the Order 37 by the Commission. Myton, Executive Director Date l 52 Teacher Standards and Practices Commission i p 53 I PAGE 1—W STIPULATION AND ORDER-DOUGLAS SCOTT WAGERS . l ULTIMATE FINDINGS OF FACT 2 3 Douglas Scott Wagers violated Standards of Competent and Ethical Performance for 4 Oregon Educators in April 1998 by using McMinnville School District equipment and 5 electronic networks to display personal, non-educational, and sexually explicit 6 materials in violation of school district policies. t 7 8 CONCLUSIONS OF LAW 9 10 Under ORS 342.175 to 190, the Commission may revoke or suspend a license or impose ll other disciplinary sanctions when an educator violates Standards of Competent and 12 Ethical Performance for Oregon Educators. 13 l4 ORDER 15 16 The Commission suspends the Teaching License of Douglas Scott Wagers for thirty (30) 17 days frorn the date of this order, for gross neglect of duty. Prior to reinstatement of his 18 license, the Commission shall require Mr. Wagers to undergo, at his own expense, an l9 evaluation by a mutually acceptable medical professional who can attest to Mr. Wagers’ 20 fitness to work with children and/ or teenagers. Upon reinstatement of his license, Mr. 21 Wagers shall be on probation for a period of two years. During probation Mr. Wagers 22 shall: 23 1. Conduct himself as a law-abiding citizen. 24 25 2. Abide by the requirements of Standards of Competent and Ethical 26 Performance for Oregon Educators. 27 ‘ 28 3. Pursue at his own expense a treatment program, if recommended, 29 outlined by the medical professional who conducts the evaluation of 30 fitness outlined above. 31 32 4.
