1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Licensure of ) AND 5 COLIN WESLEY CARR ) FINAL ORDER OF REPRIMAND 6 On January 8, 2009, the Teacher Standards and Practices Commission (Commission) 7 received a report from the Nestucca Valley School Distinct relating that Colin Carr was 8 investigated by the district for consuming alcohol during a trip to attend a football game 9 Carr fully cooperated with the Commission's investigation. After review of the matters 10 alleged, Carr and the Executive Director agree that their respective interests, together with the 11 public interest, are best served by a stipulation to certain facts and a public reprimand. 12 This document sets forth the facts upon which the parties have agreed and the 13 stipulated sanction to be imposed. Carr stipulates that there is sufficient evidence in the 14 Commission's files and records to support the findings of fact, conclusions of law, and order set 15 forth below. 16 By signing below, Carr acknowledges, understands, stipulates, and agrees to the 17 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 18 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 19 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 20 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 21 document and disclosed to the public by the Commission upon request; (iii) this Stipulation and 22 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 23 Commission does not approve and adopt this Stipulation and Final Order, then neither Carr nor 24 the Commission are bound by the terms herein; (iv) he has fully read this Stipulation and Final , 25 Order, and understands it completely; (v) he voluntarily, without any force or duress, enters into 26 this Stipulation and Final Order and consents to issuance and entry of the Stipulated Final Order 27 below; (vi) he states that no promises or representations have been made to induce him to sign Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND — CARR 1 this Stipulation and Final Order; and (vii) he has consulted with an attorney regarding this 2 Stipulation and Final Order and has been fully advised with regard to his rights thereto, or 3 waives any and all rights to consult with an attorney prior to entering into this Stipulation and 4 Final Order and issuance and entry of the Stipulated Final Order below. 5 STIPULATION OF FACTS 6 1. Colin Carr currently holds an Initial I Teaching License that was issued by the 7 Commission on August 20, 2006. The license is valid through August 19, 2010. 8 2. Carr is currently employed by the Nestucca Valley School District as a Learning 9 Center teacher and also as varsity football coach. 10 2. On November 7, 2008, during trip for a football game Carr consumed an alcoholic 11 drink with dinner. Carr also consumed at least one alcoholic beverage that same evening in his 12 hotel room. 13 3. This 24 conduct constitutes Gross Neglect of Duty in violation of OAR 584-020-0040(4)(n) as it 25 incorporates OAR 584-020-010(5) (Use professional judgment). The Commission has the 26 authority to impose discipline in this matter under ORS 342.120 through 342.430 and OAR 27 Chapter 584. 28 /// Page 2 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND — CARR i FINAL ORDER 2 The Commission hereby adopts and incorporates herein the above findings of fact and 3 conclusion of law and based thereon, here by imposes a Public Reprimand on Colin Wesley 4 Carr.
