9 On or about October 13, 1999, the Teacher Standards and Practices Commission >
10 received a copy of the Temporary Sentencing Order from Michael D. Schrunk,
ll Multnomah County District Attorney, indicating that Randolph Davis pled guilty and
12 was convicted of Rape III and two counts of Sodomy III. The Executive Director took
l3 action to notify Mr. Davis of intent to revoke his teaching license, and to inform .
14 himopportunity for hearing. The notice, dated October 27, 1999, and signed by David
15 V. Myton, Executive Director, notified Davis that he had 21 days to request a hearing
16 from the date of the notice.

I8 The notice of opportunity for hearing was sent by U.S. Certified Mail, Return Receipt Requested
l9 #Z 226 504 299 to Davis at his residence. Davis did not request a hearing.

23 On September 28, 1999, Randolph Faller Davis pled guilty and was convicted of one count of
24 Rape III, ORS 163.355 and two counts of Sodomy III, ORS 163.385 in Multnomah County
25 Circuit Court

l 29 Randolph Faller Davis pled guilty and was convicted of one count of Rape III, a Class C felony
30 and two counts of Sodomy III, a Class C felony.

34 Under ORS 342.175 conviction for the cn'mes of Rape III and Sodomy III requires the
35 Commission to revoke the license of an educator.
