Gianotti, Superintendent, Camas 9 Valley School District, indicating that Trevor Jay Lian (Lian) served without a valid 10 teaching license beginning on October 7, 2002. 11 After review of the matters alleged, Mr. Lian and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to 13 certain facts and a suspension of his right to apply for a teaching license until May 12, . 2004. Mr. Lian fully cooperated with the Commission’s investigation and did not contest 15 the allegations. 16 This Order sets forth the facts upon which the parties have agreed and the 17 sanction to be imposed. Mr. Lian stipulates that there are sufficient facts contained in 18 the Commission’s files and records to support the findings of fact and conclusions of law 19 set forth below. In entering into this stipulation, Mr. Lian waives the right to a hearing to 20 contest the finding of fact, conclusion of law and order set forth below. 21 This stipulation is contingent upon approval and adoption of the Order by the 22 Commission. If the Commission does not adopt this Order, neither Mr. Lian nor the 23 Commission are bound by these Stipulations and Mr. Lian retains all rights to a hearing 24 on the allegations. The Commission issued a Transitional Teaching License to Mr. Lian on 3 October 7, 1999, valid until October 7, 2002. On May 13, 2003, the Commission issued 4 a 30-day extension to Mr. Lian’s Transitional Teaching License based upon application 5 and supporting request from Camas Valley School District. ' 6 2. Mr. Lian was employed as a teacher for Camas Valley High School, Camas 7 Valley School District, from September 2001, to June 2003. 8 3. Mr. Lian knowingly served without a license from October 7. 2002, to May 12, 9 2003. 10 4. On July 12, 2002, Mr. Lian was convicted of Possession of a Controlled 11 Substance (marijuana) in and for the Salina City Justice Court, County of Sevier, State 12 of Utah. This misconduct constitutes Gross Neglect of Duty in violation 22 of OAR 584-020-0040(4)(c). Trevor Jay Lian violated OAR 584-020-0040(5)(c) 23 regarding his conviction for Possession of a Controlled Substance. This misconduct 24 constitutes Gross Unfitness. The Commission’s authority to impose discipline in this ‘ matter is based upon ORS 342.175. At 4 the end of the suspension period Mr. Lian shall be eligible to submit application for an 5 Initial Teaching License.
