OF THE STATE OF OREGON 3 ln the Matter of the ) 4 Licensure of ) DEFAULT ORDER OF 5 BRENDA CATHLEEN MACE ) DENIAL OF LICENSURE i ) 8 On April 7, 2003, the Teacher Standards and Practices Commission issued a Notice of 9 Opportunity for Hearing to Brenda Cathleen Mace, in which the Commission proposed to deny 10 issuance of a license under ORS 342.143 and its administrative rules implementing that legal 11 authority OAR 584-050-0006(2). The Notice was sent via U.S. First Class Mail and U.S. 12 Certified Mail Receipt #7001 0320 0005 0740 4294 to the address Ms. Mace provided to the 13 Commission. The certified mail receipt was signed by Thomas Dinkle and returned to the 14 Commission on April 14, 2003. Brenda Mace did not request a hearing. 15 The Notice of Opportunity for Hearing, signed by Victoria Chamberlain, Executive Director, stated: i If a request for hearing is not received within this 21-day period, your right to 18 hearing shall be considered waived unless your failure to request a hearing was 19 beyond your reasonable control. If you do not request a hearing or if you fail to 20 appear at a hearing, the Commission will uphold the denial of your application for 21 an Oregon teaching license. ii Based on the foregoing, the Commission finds Brenda Cathleen Mace in default and 24 such default is hereby entered. Based on the records and files of the Commission, the 25 Commission enters the following findings of fact, conclusions of law and order. 26 FINDINGS 0F FACT 27 1. Ms. Mace held a Transitional Teaching License with an endorsement in Early 28 Childhood Education and Elementary Multiple Subjects Self-Contained, issued September 3, 29 1999, valid until September 3, 2002. A Transitional Teaching License is issued for three years 30 and is non-renewable. 1 2. On November 26, 2002, TSPC received an Application for Educator License Form C- i 1 signed by B. Cathleen Mace along with additional documentation for renewal of her PAGE 1 - DEFAULT ORDER OF DENIAL OF LICENSURE-BRENDA CATHLEEN MACE 1 Transitional Teaching License. Ms. Mace was notified that her Transitional Teaching License . was not renewable and that she would need to qualify for an Initial Teaching License pursuant 3 to OAR 584-060-0011. 4 3. On March 27, 2003, Ms. Mace submitted documentation to satisfy the recent 5 experience requirements; however did not provide evidence of her knowledge of U.S. and 6 Oregon civil rights laws by documenting success on an examination approved for that purpose 7 by TSPC. 8 CONCLUSIONS OF LAW 9 Ms. Mace previously held a Transitional Teaching License which is not renewable 10 pursuant to OAR 584-060-0161; therefore her application for a Transitional Teaching License is 11 denied. Under current rules, Ms. Mace must apply for an Initial Teaching License, but she has 12 not provided evidence of her knowledge of U.S. and Oregon civil rights laws pursuant to OAR 13 584-060-0011(1)(e).
