1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION , 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER 6 JANEK GALA ) REVOKING LICENSE 7 ) 8 9 On or about July l7, 1997, the Teacher Standards and Practices Commission received 10 information from Ted Adams, Superintedent of Eagle Point School District, indicating that ll Janek Gala resigned in lieu of termination for insubordination and unprofessional conduct. 12 The Resignation Agreement, dated June 3, 1996, was effective April 24, 1996. On January 16, 13 1998 the Commission took action to suspend Mr‘ Gala's teaching license for failure to comply l4 with the fingerprinting requirement. On March 13, 1998, the Commission took action to 15 charge Mr. Gala with violation of TSPC Standards.. The Executive Director took action to notify 16 Mr. Gala of intent to revoke his right to reinstate his Oregon Teaching License, and to inform 17 him of his opportunity for hearing. 18 19 The notice was dated March l8, 1998, and signed by David V. Myton, Executive Director, was 20 sent by U.S. First Class Mail and U.S. Certified Mail, Return Receipt Requested. The Certified 21 Mail was returned to TSPC marked “Refused,” However, the U.S. First Class Mailing was not 22 returned to TSPC. Mr. Janek did not request a hearing. 23 24 FINDINGS 0F FACT 25 26 Janek Gala violated ORS 342.175 (1) (b) and (c) and (5) and OAR 584-020-0010, 0035, and , 27 0040 AND ORS 342.223 by: , 28 29 1. Exhibiting angry, hostile and aggressive behavior towards students, staff and 30 administrators in Eagle Point School District from 1986 through 1996 as delineated in 31 a letter to Mr. Gala from Ted Adams, Superintendent of the district, dated March 27, 32 1996. 33 34 2. Using unreasonable force and inappropriate language in breaking up a fight between 35 students on or about October 5, 1993. 36 37 3.
