CULLEY ) AND PROBATION 6 On or about May 31, 2005, the Teacher Standards and Practices Commission 7 (Commission) received a report from Kathryn Baker, Superintendent, Salem-Keizer School 8 District, indicating that Travis B. Culley (Culley) may have engaged in inappropriate conduct 9 with a minor, 1O On June 10, 2005, Mr. Culley applied to renew his Initial Teaching License. On August 11 2, 2005, the Executive Director issued a Notice of Denial of Teaching License and Opportunity 12 for Hearing to Mr. Culley based upon evidence that the applicant may lack fitness to serve. On 13 August 9, 2005, Adam Arms, Attorney at Law, requested a hearing on Mr. Culley’s behalf. 4 Mr. Culley fully cooperated with the Commission’s investigation in this matter. After Q review of the matters alleged, Mr. Culley and the Commission agree that their respective 16 interests, together with the public interest, are best served by a stipulation to certain facts and 17 the imposition of a six (6) month suspension of Iicensure followed by a two (2) year period of 18 probation upon reinstatement of Iicensure. 19 This Order sets forth the facts upon which the parties have agreed and the sanction to 2O be imposed. Mr. Culley stipulates that there are sufficient facts contained in the Commission‘s 21 files and records to support the findings of fact and conclusions of law set forth below. In 22 entering into this stipulation, Mr. Culley waives the right to a hearing to contest the findings of 23 tact, conclusions of law and Order set forth below. Mr. Culley understands that the probation 24 will be subject to specific conditions. 25 This stipulation is contingent upon approval and adoption of the Order by the ‘6 Commission. Mr. Culley holds an Initial Teaching License with Chemistry and Integrated Science 5 Endorsements, issued August 16, 2001, valid through June 21, 2005. 6 2. Mr. Culley began employment with the Salem-Keizer School District on August 28, 7 2001. Mr. Culley served as a Science Teacher at Sprague High School. Mr. Culley entered into 8 a settlement agreement with the District and resigned his teaching position effective June 16, 9 2005. ' 10 3. Mr. Culley failed to maintain an appropriate professional student-teacher relationship 1 1 with a female student at Sprague High School during the 2004-2005 school year. Mr. Culley 12 wrote an overly personal note to the student and expressed a professionally inappropriate 3 interest in her personal life. ‘i 4. Culley failed to maintain a professional student-teacher relationship with an 25 11m grade female student at Sprague High School during the 2004-2005 school year. Mr. 26 Culley failed to maintain appropriate professional student-teacher relationships with both male ' and female student attending Sprague High School during the years he taught at Sprague High 28 School. This constitutes Gross Neglect of Duty in violation of OAR 584-020-0040(4)(o) as it Page 2 STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION - CULLEY 1 incorporates OAR 584-020-0035(1) (c). The Commission's authority to impose discipline in this .2 matter is based upon ORS 342.175. 3 ORDER 4 Travis B. Culley’s Initial Teaching License is suspended for a period of six (6) months 5 effective the date of this Order. At the end of this suspension period, Mr. Culley‘s Initial 6 Teaching License will be reinstated upon: 7 1. Submission of a complete application and fees pursuant to OAR 584-050-0015(3); 8 and 9 2. Submission of documentation that he has undergone an evaluation by a 10 psychotherapist or medical professional acceptable to the Commission, and the evaluator 11 submits a written report to the Commission attesting that Mr. Culley is fit to work with children 12 and teenagers. Any costs associated with the assessment or treatment will be Mr. Culley‘s 8 responsibility. q Upon the reinstatement of Iicensure, Mr. Culley shall be placed on probation by the 15 Commission for a period of two (2) years, subject to the following conditions: 16 1. Mr. Culley shall substantially comply with any treatment or counseling as 17 recommended by the individual who completed the evaluation described above. 18 Mr. Culley shall authorize and sign any consent forms as necessary for the treatment provider 19 or counselor to furnish records to or discuss Mr. Culley's treatment with the Commission. 20 2. Mr. Culley shall participate In a Commission approve boundaries training program, 21 successfully complete said program within the first year of the probation period and report in 22 writing to the Executive Director. 23 3. Mr. Culley shall comply with all Standards for Competent and Ethical Performance of 24 Oregon Educators under Oregon Administrative Rules, Chapter 584, Division 020.
