SHEETS ) AND PROBATION ~ g ) 1O On or about August 28, 2001, the Teacher Standards and Practices Commission 11 (Commission) received an application for a Transitional Teaching License from Mark E. Sheets 12 together with a request for expedited service from Culver School District. 13 Mr. Sheets responded “yes” to character question, “8. Have you ever been convicted or 14 been granted conditional discharge by any court for: (a) any felony; (b) misdemeanor; or (c) any 15 major traffic violation... “ Mr. Sheets also responded "yes" to character question, “10. Have you 16 ever entered a plea of guilty or No Contest relative to any charge for an offense listed in 17 question 8.?“ Mr. Sheets provided information from Draper Justice Court that he pied guilty to 18 Theft on April 17, 2001. 19 After review of the facts in this matter, Mr. Sheets and the Executive Director agree that ' 20 their respective interests, together with the public interests, are best served by a stipulation to 21 certain facts, followed by a probation of two (2) years. 22 This Order sets forth the facts upon which the parties have agreed and the sanction to 23 be imposed. In entering into this stipulation, Mr. Sheets waives the right to a hearing to contest 24 the findings of fact, conclusion of law and order set forth below. Mr. Sheets understands that 25 the Commission will impose a two (2) year probation with specific conditions. 26 This stipulation is contingent upon approval and adoption of the Order by the 27 Commission. If the Commission does not adopt this Order, neither Mr. Sheets nor the 28 Commission are bound by these Stipulations and Mr. Sheets retains all rights to a hearing on 29 the allegations. Sheets together with a request for expedited service from 4 Culver School District. 5 2. Mr. Sheets currently holds an lndiana Teaching License valid May 7, 1998 to May 7, 2003. 6 3. On or about March 28, 2001, Mr. Sheets was arrested for retail theft (shoplifting) in Draper, 7 Utah. Mr. Sheets pied guilty at arraignment on April 17, 2001, and was granted diversion in 8 the matter. The Court held sentencing in abeyance for 12 months indicating the matter 9 would be dismissed if there are no additional violations during this period. The Court 10 ordered Mr. Sheets to complete counseling and submit monthly counseling reports. 11 4. Mr. Sheets has no prior or subsequent criminal convictions. 12 lT IS SO STIPULATED: 13 .. . ~\ p . Myton, Executive Director Date 19 20 CONCLUSION OF LAW 21 Conviction for a misdemeanor crime may be used as evidence to establish an applicants 22 lack of fitness to serve as a teacher under ORS 342.143. - 23 ORDER 24 The Commission adopts the above Findings of Fact and places Mr. Sheets on probation 25 with the Commission for two (2) years. 26 // / '27 / // Page 2 STIPULATION OF FACTS AND PROBATION - SHEETS 1 The Commission authorizes issuance of a Transitional Teaching License to Mark E. ' 2 Sheets subject to all standard terms and conditions and subject to the following special terms of 3 probation: 4 1, The Commission places Mr. Sheets on a two (2) year probation to commence September 4, 5 2001. 6 2. The probation shall remain in effect subject to the following conditions: 7 a. Mr. Sheets shall report in writing within ten days to the Executive Director of the 8 Commission any arrest or citation for any felony, misdemeanor, major traffic 9 violation; 1O b. Mr. Sheets shall submit a copy of the Draper Justice Court ordered monthly reports 11 to the Executive Director of the Commission; and 12 c. Mr. Sheets shall comply with theStandards for Competent and Ethical Performance 13 of Oregon Educators under OAR Chapter 584, Division 020. ‘I 4 Violation of any of the terms of probation shall constitute an independent basis for the 15 Commission to revoke Mr. Sheets‘ teaching license or otherwise impose discipline, after first 16 providing Mr. Sheets with notice and opportunity for hearing. 17 Dated this le'day of September 2001. 18 TEACHER STANDARDS AND PRACTICES COMMISSION 19 . 22 David V.
