Ms. Wilson reported a criminal conviction on the 10 character question section of Application for Educator License Form C-1. Ms. Wilson 11 provided documentation of her probation termination for conviction on 2 counts of Theft 12 on September 23, 1996, in Arizona Superior Court, Coconino County. 13 After review of the facts in this matter, Ms. Wilson and the Executive Director 14 agree that their respective interests, together with the public interests, are best served 15 by a stipulation to certain facts and the issuance of licensure subject to a three (3) year 16 probation. ~ 17 This Order sets forth the facts upon which the parties have agreed and the 18 sanction to be imposed. In entering into this stipulation, Ms. Wilson waives the right to a 19 hearing to contest the findings of fact, conclusion of law and order set forth below. 20 Ms. Wilson understands that the Commission will impose a three (3) year probation with 21 specific conditions. 22 This stipulation is contingent upon approval and adoption of the Order by the 23 Commission. If the Commission does not adopt this Order, neither Ms. Wilson nor the 24 Commission are bound by these Stipulations and Ms. Wilson retains all rights to a t 25 hearing on the allegations. - Page 1 STIPULATION OF FACTS AND PROBATION - WILSON . 1 STIPULATION OF FACTS 2 1. On or about December 12, 2001, the Commission received an application for a 3 Transitional Teaching License from Sarah Fawn Wilson. 4 2. Ms. Wilson currently holds an Arizona Teaching License issued on June 20, 5 2001, valid through June 20, 2003. 6 3. On July 11, 1996, the Coconino County Grand Jury indicted Sarah Fawn 7 Wilson for the crime of Fraudulent Schemes for theft from her employer, Target Stores, 8 in Flagstaff, Arizona. On September 23, 1996, Ms. Wilson was convicted on two counts 9 of Theft-Fraudulent Schemes in Arizona Superior Court, Coconino County and 10 sentenced to: three (3) years probation; 100 hours community service; alcohol and drug 11 testing; and ordered to pay $3,600.00 in restitution. ' 12 4. Conviction of a crime may be used as evidence to establish a n 24 applicants lack of fitness to serve as a educator pursuant t0 ORS 342.143. . 25 ORDER Page 2 STIPULATION. OF FACTS AND PROBATION - WILSON . 1 The Commission adopts the above Stipulation of Facts and authorizes the 2 issuance of a Transitional Teaching License to Sarah Fawn Wilson subject to all 3 standard terms and conditions. 4 Furthermore, the Commission imposes a three (3) year probation to commence 5 on May 15, 2002, subject to the following special terms: 6 1. Ms. Wilson shall conduct herself as a law-abiding citizen; 7 2. Ms. Wilson shall report in writing within ten days to the Executive Director of 8 the Commission any arrest or citation for any felony, misdemeanor, major 9 traffic violation; 1O 3. Ms. Wilson shall comply with the Standards for Competent and Ethical 11 Performance of Oregon Educators under OAR 584.
