BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON In the Matter of the ) STIPULATION OF FACI‘ S AND Educator License of ) FINAL ORDER OF REPRIMAND GREGORY EARL BROWN ) AND PROBATION On October 24, 2014, the Teacher Standards and Practices Commission (Commission) received a complaint from a patron of the Central Curry School District alleging professional misconduct on the part of licensed educator, Gregory Earl Brown (Brown). l After review of the matters alleged, Brown and the Commission agree that their respective interests, together with the public interest, are best served by a stipulation to ‘ certain facts and the imposition of a public reprimand and four year probation period. By signing below, Brown acknowledges, understands, stipulates, and agrees to l the following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand and Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon and subject to approval and adoption by the Commission. If the Commission does not approve and adopt this Stipulation and Final Order, then neither Brown nor the Commission are bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and understands it completely; (v) he voluntarily, without any force or duress, enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated Final Order below; (vi) he states that no promise or representation has been made to induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an attorney regarding this Stipulation and Final Order and has been fully advised with regard to his rights thereto, or waives any and all rights to consult with an attorney prior to entering into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. STIPULATION 0F FACTS 1. Gregory Earl Brown has been licensed by the Commission since May 15, 2003. Brown's Professional Teaching License, with endorsements in Foundational Mathematics (PK-12) and Special Education: Generalist (PK-12), is valid from May 20, 2015 through May 19, Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND AND PROBATION- GREGORY EARL BROWN 2020. During all relevant times, Brown was employed by the Central Curry School District. 2. On October 24, 2014, the Commission received a report of possible misconduct on l Brown’s part, from a patron of the Central Curry School District. Commission investigation determined that on or about October 10, 2014, while coaching a football j game in Reedsport, Oregon, Brown physically struck a student, eighteen year old CP, on l his helmet near the facemask, forcibly pushing CP’s unsnapped hclmet back along his i head. Multiple witnesses reported Brown was visibly angry and yelling at CP. After i Brown struck CP on the front of the helmet, he used CP’s facemask to pull CP closer to him while Brown continued to shout. Witness statements indicated a referee and other coaching staff intervened to separate Brown from your contact with CP. On February l8, 2015, Brown was criminally charged with Harassment (Class B misdemeanor) related to Brown’s conduct during the October 10, 2014, incident. On October 15, 2015, these charges were dismissed pursuant to a court diversion agreement. Brown's conduct constitutes gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020-001o(1) (Recognize the worth and dignity of all persons and respect for each individual), OAR 584-020-001o(5) (Use professional judgment), OAR 584-020-0025(2)(e) (Using district lawful and reasonable rules and regulations), OAR 584-020-003o(2)(b) (Skill in communicating with administrators, students, staff, parents, and other patrons); (OAR 584-020-oo4o(4)(o) as is incorporates OAR 584-020-0035(1)(c)(D) (Honoring ‘ Page 2 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND AND PROBATION- GREGORY EARL BROWN appropriate adult boundaries with students in conduct and conversation at all times); and OAR 584-020-0040(4)(d) (Unreasonable physical force against students, fellow employees, or visitors to the school, except as permitted under ORS 339.250). The Commission’s authority to impose discipline in this matter is based upon ORS 342.175. ORDER Based on the foregoing, the Commission hereby orders as follows: 1. The Commission adopts and incorporates herein the above findings of fact and conclusions of law, and based thereon, imposes a Public Reprimand on Gregory Earl Brown’s Educator License(s); 2. Brown is hereby placed on probation for a period of four (4) years from the date this order is signed by the Commission subject to the following conditions: I a.
