6 On March 6, 2006, the Teacher Standards and Practices Commission (Commission)
7 received a report from Deborah Sommer, Superintendent, Canby School District alleging that
8 Jeremy Lloyd Mize (Mize), may have violated the standard of Gross Unfitness by his failure to
9 make a mandatory report of child abuse under ORS 4198.010.
1O After review of the matters alleged, Mr. Mize and the Commission agree that their
11 respective interests, together with the public interest, are best served by a stipulation t0 certain
12 facts and a public reprimand.
13 This document sets forth the facts upon which the parties have agreed and the
14 stipulated sanction to be imposed. Mr‘ Mize stipulates that there is sufflcient evidence in the
' Commission's files and records to support the findings of fact, conclusions of law, and order set
16 forth below.
17 By signing below, Mr. Mize acknowledges, understands, stipulates, and agrees to the
18 following: (i) he has been fully advised of his rights to notice and a hearing to contest the
19 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all
20 such rights and any rights to appeal or othenlvise challenge this Stipulation of Facts and Final
21 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public
22 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and
23 Final Order is contingent upon and subject to approval and adoption by the Commission lf the
24 Commission does not approve and adopt this Stipulation and Final Order, then neither Mr. Mize
25 nor the Commission are bound by the terms herein; (iv) he has fully read this Stipulation and
26 Final Order, and understands it completely; (v) he voluntarily, without any force or duress,
' enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated

1 Final Order below; (vi) he states that no promises or representation has been made to induce
. him to sign this Stipulation and Final Order; and (vii) he has consulted with an attorney

3 regarding this Stipulation and Final Order and has been fully advised with regard to his rights

4 thereto, or waives any and all rights to consult with an attorney prior to entering into this

5 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below.

6 STIPULATION 0F FACTS

7 1. Mr‘ Mize holds an Initial Teaching License issued June 21, 2006, valid through

8 September 23, 2009, with a high school authorization and Chemistry and Physics

9 endorsements.
10 2. Mr. Mize began employment as a science teacher for Canby High School, Canby
11 School District on August 25, 2003i Mr. Mize resigned his employment with the district at the
12 end of the 2005-2006 school year due to a change in his wife's employment.

13 3. On February 7, 2006, a sixteen year old female student disclosed to Mr. Mize that
’ she was involved in a sexual relationship with a thirty year old uncle for the last year‘ Mr, Mize
15 failed to report the disclosure to law enforcement or the Department of Human Services in the

16 allotted 24 hour period.

24 CONCLUSIONS OF LAW

25 Jeremy Lloyd Mize’s failure to make an immediate report on an incident of possible child
26 abuse to the Department of Human Services or law enforcement constitutes gross neglect of
. duty in violation of OAR 584-020-0040(4)(n) (substantial deviation from professional standards

1 of ethics) as it incorporates OAR 584-020-0010(5) (use of professional judgment) and OAR 584-
. 020-0025(3)(a) (ethical educator obeys the laws). This misconduct constitutes Gross Neglect of
3 Duty. The Commission has the authority to impose discipline in this matter under ORS 342.120
4 through 342.430 and OAR Chapter 584.
5 ORDER
6 The Commission hereby adopts and incorporates herein the above findings of fact,
7 conclusions of law and imposes a Public Reprimand upon the licensure of Jeremy Lloyd Mize.
8 This order shall serve as the Public Reprimand.
