In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) LICENSE REVOCATION AND 6 BRANDYE NOELLE SAUVAJON ) REVOCATION OF RIGHT TO 7 ) APPLY FOR A LICENSE 8 9 On April 20, 2007, the Teacher Standards and Practices Commission (Commission) issued a 10 Notice of Opportunity for Hearing to Brandye Noelle Sauvajon (Sauvajon) in which the Commission 11 charged her with conviction of a crime listed in ORS 342.143(3). The Notice was sent via U.S. First 12 Class Mail and U.S. Certified Mail Receipt 7005 1160 0001 0494 2925 to the address obtained by the 13 Commission. The certified mail receipt was not returned to the Commission. The Notice of 14 Opportunity of Hearing, dated April 20, 2007, and signed by Victoria Chamberlain, Executive Director, 15 stated: 16 "You, Brandye Noelle Sauvajon, are entitled to a hearing on the proposed action of the 17 Commission. If you want a hearing, you must tile a written request tor a hearing with 18 the Commission within 21 days of the date of this notice. Attached to this notice is a . copy 01‘ the procedures, right of representation and other rights of parties relating to the conduct of a hearing as required under ORS 183.413(2)." 21 22 Ms. Sauvajon did not request a hearing. The Commission, therefore, finds 23 Ms. Sauvajon to be in default and enters the following findings of fact, conclusions of law and 24 order, based on the files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. The Commission issued Ms. Sauvajon an Initial Teaching License on August 30, 2006, 27 valid until November 21, 2009, with Language Arts and Multiple Subjects Endorsements. 28 2. Ms. Sauvajon began employment with McKenzie School District on August 30, 2006. 29 On December 15, 2006, Ms. Sauvajon resigned in lieu of termination. 30 3. On March 14, 2007, Ms. Sauvajon was convicted of Endangering the Welfare of a Minor, 31 ORS 163.575 and Furnishing Alcohol to a Person Under 21 Years of Age, ORS 471.410, in the Circuit 32 Court of the State of Oregon for Lane County. ' /// 1 — DEFAULT ORDER OF LICENSE REVOCATION AND REVOCATION OF RIGHT TO APPLY - SAUVAJON I CONCLUSIONS OF LAW . Ms. Sauvajon‘s conviction of Endangering the Welfare of a Minor, ORS 163.575 is listed in 3 ORS 342.143(3). The Commission is required to revoke the Initial Teaching License issued to 4 Ms. Sauvajon and revoke her right to apply for a license pursuant to ORS 342.175(2). 5 Ms. Sauvajon’s conviction for Furnishing Alcohol to a Person Under 21 Years of Age, ORS 6 471.410 constitutes Gross Unfitness as defined in OAR 584-020-0040(5)(c).
