s On January 7, 2009, the Teacher Standards and Practices Commission

9 (Commission) issued a Notice of Opportunity for Hearing to James Barney Breedlove
10 (Breedlove) in which the Commission charged him with misconduct under ORS

11 342.177(3). The Notice was sent via U.S. First Class Mail and U.S. Certified Mail

12 Receipt 7006 2760 0000 1638 5742 to the address on file with the Commission. The
13 certified mail receipt was returned to the Commission on January 12, 2009, signed by
14 James Breedlove. The Notice of Opportunity of Hearing, dated January 7, 2009, and
15 signed by Victoria Chamberlain, Executive Director, stated:

16 "You, James Breedlove, are entitled to a hearing on the proposed action

17 of the Commission. If you want a hearing, you must file a written request

18 for a hearing with the Commission within 21 days of the date of this notice.

19 Attached to this notice is a copy of the procedures, right of representation

20 and other rights of parties relating to the conduct of a hearing as required

21 under ORS 183.413(2)"

23 Mr. Breedlove did not request a hearing. The Commission, therefore, finds

24 Mr. Breedlove to be in default and enters the following findings of fact,

25 conclusions of law and order, based on the files and records of the Commission

26 concerning this matter.

27 FINDINGS OF FACT

, zs 1. The Commission issued an Initial 1 Teaching License to Mr. Breedlove on July
29 20, 2006, valid until October 13, 2010, with endorsements in Language Arts and
3o Multiple Subjects.

2 2. On January 29, 2007, the Commission received a report from Jackson County
3 School District regarding Mr. Breedlove‘s conduct on “Myspace.” The report
4 included information regarding a meeting the district had with Mr. Breedlove on
5 July 26, 2007, in which Mr. Breedlove admitted that the “Myspace” page in
6 question was his and that he posted the content in question on the web page.
7 The content in question included a posting on November 8, 2006, entitled
s "Guidelines for Male Teachers of Teenage Girls" and a posting made on January
9 8, 2007, entitled “Underage Girls." The postings, which included numerous
10 sexual references to students, constitute a failure to use professional judgment.
11 CONCLUSIONS 0F LAW
l: Mr. Breedlove‘s posting of inappropriate writings about student-teacher
14 relationships on his MySpace page constitutes gross neglect of duty in violation with
15 OAR 584»020-0040(4)(n) (“Substantial deviation from professional standards of
16 competency set forth in OAR 584-020-0010 through 584-020-0030”) as it incorporates
17 OAR 584-020-0010(5) (“Use of professional judgment").

2 The Commission adopts and incorporates herein the above findings of facts and
l 3 conclusions of law, and based thereon, hereby revokes the Initial I Teaching License
4 of James Barney BreedIOZVel.
