1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Educator License of ) FINAL ORDER OF REPRIMAND 5 CORINA ROSE DONALD ) AND PROBATION ‘3 8 On or about April 6, 2015, the Teacher Standards and Practices 9 Commission (Commission) received a report from the Portland Public School 1O District indicating that Corina Rose Donald (Donald) was suspected of violating 11 District Policies and Professional Standards. 12 After review of the matters alleged, Donald and the Commission agree that 13 their respective interests, together with the public interest, are best served by a 14 stipulation to certain facts, the imposition of a public reprimand of her Oregon 15 educator license, followed by four (4) years of probation. 16 By signing below, Donald acknowledges, understands, stipulates, and 17 agrees to the following: (i) she has been fully advised of her rights t0 notice and a 18 hearing to contest the findings of fact, conclusions of law, and order set forth 19 below, and fully and finally waives all such rights and any rights to appeal or 20 otherwise challenge this Stipulation of Facts and Final Order of Reprimand and 21 Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a 22 public document and disclosed to the public upon request by the Commission; 23 (iii) this Stipulation and Final Order is contingent upon and subject to approval 24 and adoption by the Commission. If the Commission does not approve and adopt 25 this Stipulation and Final Order, then neither Donald nor the Commission are 26 bound by the terms herein; (iv) she has fully read this Stipulation and Final 27 Order, and understands it completely; (v) she voluntarily, without any force or 28 duress, enters into this Stipulation and Final Order and consents to issuance and 29 entry of the Stipulated Final Order below; (vi) she states that no promise or 3O representation has been made to induce her to sign this Stipulation and Final 31 Order; and (vii) she has consulted with an attorney regarding this Stipulation and 32 Final Order and has been fully advised with regard to her rights thereto, or 33 waives any and all rights to consult with an attorney prior to entering into this Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND AND PROBAT|ON- CORINA ROSE DONALD 1 Stipulation and Final Order and issuance and entry of the Stipulated Final Order 2 below. Donald understands that the probation will be subject t0 specific terms 3 and conditions. 4 STIPULATION OF FACTS 5 1. The Commission has licensed Corinna Donald since August 6, 2012. Donald’s 6 Initial I Teaching License, with an endorsement in Multiple Subjects Self- 7 Contained (ECE/ELE), is valid from August 6, 2012, through June 4, 2016. 8 Donald made timely application for renewal and her license expiration is 9 pending. During all relevant times, Donald was employed by the Portland 1O Public School District. 11 2. On April 6, 2015, the Commission received information from the Portland 12 Public School District (PPSD) indicating Donald may have committed acts 13 which constitute gross neglect of duty. The district reported they suspected 14 Donald had been under the influence of alcohol on school grounds. On 15 November 21, 2014, a school administrator reported to human resources that 16 Donald smelled of alcohol during a meeting. School officials did not take any 17 steps or have any discussion with Donald at the time. When informed of the 18 allegation weeks later, Donald denied the allegation. On November 24, 2015, 19 school officials again smelled alcohol on Donald’s person and requested 20 Donald be tested. Donald agreed to be tested, and Donald tested positive with 21 the two samples averaging a blood alcohol content (BAC) of 0.048%. Donald 22 disclosed that she had been to a Portland Blazers game the night before and 23 contends she had two beers before the game and additional alcohol after the 24 game. Donald went to work the next day and, she did not perceive that she 25 was under the influence at any time while at school. The District has a zero- 26 tolerance alcohol policy. Based on the results of the tests and the fact that she 27 was a probationary teacher, she resigned her position with the District on 28 March 9, 2015. 29 3. Although the district’s investigation indicated that Donald may be suffering 3O from alcoholism, Donald has denied any alcohol abuse issues and informed 31 commission staff that she has sought no related treatment. However, in order 32 to address any concerns on the part of the Commission, Donald sought an Page 2 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND AND PROBATION- CORINA ROSE DONALD 1 evaluation in September 2016 by a BA CADCI evaluator, at Western 2 Psychological & Counseling Services (WPCS), and has voluntarily provided the 3 summary of the evaluation report to the Commission as a confidential medical 4 record. The evaluator did not find a basis for any substance abuse disorder but 5 did recommend that if her emotional symptoms increase in the next year, that 6 she should seek out a counselor. 7 4. In addition, Donald has identified and completed an 8-hour Drug and Alcohol 8 Awareness Course on her own initiative. 9 5. Further, Donald has identified a counselor and has met with the counselor for 10 four sessions. Her counselor recently indicated the Donald has “actively 1 1 engaged” in the counseling and “is willing to learn, process, and grow.” Donald 12 will continue to meet with her as often as it is determined to be helpful by the 13 counselor. 14 IT IS SO STIPULATED: 15 CM ngiL-nifi 01125111 16 Corina Rose Donald Date I; figOflmI 10/87/11 19 Trent Danows ', Co-Interim Executive Director Date 20 Teacher Standards and Practices Commission 21 22 CONCLUSION OF LAW 23 Donald was working under the influence of alcohol while on duty and 0n 24 school property as described above. This conduct constitutes gross neglect of duty 25 in violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates 26 OAR 584-020-0010(5) (Use professional judgment), OAR 584-020-0025(2)(e) 27 (Using district lawful and reasonable rules and regulations); and OAR 584- 28 020-0040(4)(g) (Appearing on duty or at any district-sponsored activity while 29 under the influence of alcohol 0r any controlled substance). 3O The Commission’s authority to impose discipline in this matter is based 31 upon ORS 342.175. 32 ORDER Page 3 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND AND PROBATION- CORINA ROSE DONALD 1 The Commission hereby adopts and incorporates herein the above 2 findings of fact, conclusions of law, and based thereon hereby imposes a Public 3 Reprimand on Corina Rose Donald’s Oregon educator license upon adoption of 4 this order. 5 Furthermore, the Commission shall impose four (4) years of probation 6 upon Donald to commence the date of adoption of this order and subject to the 7 following terms and conditions of probation: 8 9 1. Donald will participate and/ or continue to participate in any treatment 10 recommendations and recovery programs as indicated in the evaluation 1 1 of the WPCS (if any). 12 2. Donald, within the first year of probation, will participate in any 13 additional counseling, if needed, as recommended by the counselor. 14 3.
